Liberal Law Professor Alan Dershowitz Explains How Trump Could Come Out Victorious

Liberal law professor Alan Dershowitz on Tuesday laid out the Trump campaign's legal strategy for winning the White House through a number of legal challenges. According to Dershowitz, the strategy is to pull electoral votes away from former Vice President Joe Biden.

"The clock is a double-edged sword in this election because if they don't have enough time but if they can put forward a sufficiently strong case then they may be able to get some Republican Secretaries of States or legislatures to say, 'Look, we just don't have enough time to certify these electors' and if they can bring down the number of electors, 35 [to] 37, from the 305 and bring it down to 267 or 268 then the election goes to the House, where the Republicans win," he explained.

Dershowitz explained that the Trump Team's legal strategy is to pull enough electors away from Joe Biden that he doesn't meet the 270 threshold by the time the election needs to be certified. He also said there's no possible way for President Trump to get to 270 electoral votes in time.

"The goal is to prevent Biden from getting 270, that's why the clock is a double-edged sword," he said.

According to the Harvard professor, Bush v. Gore will be referenced if and when the Trump campaign's case makes its way to the Supreme Court. The reason: Trump's Team is focusing on the Equal Protection Clause. Their argument is that not all voters were treated equally because some had their ballots counted with an observer while others didn't. Some had rules set by other government officials and not the state legislatures, which the Supreme Court ruled against.

In order for these cases to make their way to the Supreme Court, Dershowitz said "the numbers have to be there," meaning the Trump Team successfully pulls electors away from Biden so the former vice president is no longer at the 270 threshold. The other option is for Trump's lawyers to provide "hard evidence" of irregularities occurring with voting machines, which could call into question hundreds of thousands of votes in various states.

"If that happens, then yes, it will go to the Supreme Court," Dershowitz said. "I think at least under the Constitutional challenge, the Article 2 challenge in Pennsylvania, they have a pretty good chance of winning."

I admit I don't know much about Brian Kemp. I just remember his cool campaign ads, shooting off his gun, and the ad with his daughter... I guess I thought he was "one of us".

I live in The People's Republik of Connecticut... what do I know? ;-)

I believe you are correct. 270 is the ideal number of EVs, but it is not an absolute. If a state fails to certify electors, those EVs reduce the minimum threshold

This is a good article. I’m furious at Georgia’s governor and secretary of state. They’re doing everything they can to put Biden over the top.

L. L. Lin Wood is going to raise a similar challenge to the Georgia elections. The rules, to allow mail-in balloting were written and put in place by the Georgia Governor and Secretary of State, uxurping the Constitution's requirement that the legislative branch can only make changes to existing election laws.

The Mainstream Press is going into a frenzy to declare Biden the winner. The Hitler big lie first espoused in Mein Kempf, which says something to the effect that: " the use of a lie so "colossal" that no one would believe that someone "could have the impudence to distort the truth so infamously".

I still can’t believe that two Republicans voted to certify the election in Detroit. Morons. If Trump goes down they are next.

They have BOTH since rescinded and REVERSED their votes to NOT CERTIFY.

I believe they first voted "yes" because they were threatened.

There may be a better way to get the Con law argument before Scotus in PA..and that involves a lessor race that hinges on a few votes. Dont remember how many but the Scotus ruling will make a difference in that race...
Dont know if that candidate is making a legal fight

The thought occurred to me today that the main reason Trump cannot concede the election is that to do so would be a violation of his oath of office to defend the republic ... in this case, against a fraudulent election scheme. Even if there’s not sufficient legal proof available in time, the principle of the thing is the over-riding dynamic in play.

This cannot be allowed to pass. If extra time is needed to sort out the details, make every effort to create the extra time. Once a revolution is a fait accompli, it is historically nearly impossible to reverse it. So it must be annulled before it can come into existence.

Joe Biden is not the president of the United States. And there is considerable evidence that he should never become the president of the United States.

If I knew my kids were gonna be targeted and likely hurt (because the left will go as low as it has to now) I would have reversed too.

Go ahead internet tough guys, say how you would care but it would be worth the sacrifice of YOUR children.

These aren’t fed house or senate members whose kids would get 24/7 protection.

They likely thought “no one else is making the hard decisions and choices. Why should we risk everything?”

And they’re right.

It should be a concerted effort across states in large enough numbers so no 1, 2 or 30 people can be blamed fully.

Dems are great at making concerted efforts and terrorizing our side.

Our side types.
