California authorities take down giant ‘TRUMP’ sign near highway… that was on private property

Today brings with it yet another “the First Amendment can be suspended in the name of ‘safety'” story, and it might not surprise you to know that it has something to do with California authorities removing a “TRUMP” sign:

Maybe the Trump supporter should have instead put the sign ON the highway and called it a protest:

Local authorities said that because the sign was on private property, it was just taken down but not removed:

Lauren Wonder, chief public information officer for Caltrans, told the Los Angeles Times that the sign was on private property.

For that reason, Wonder said, Caltrans workers “laid it down so it wasn’t a visual distraction” but did not completely remove the sign, which was noticed at about 7 a.m.

“This was a life and safety issue because there were concerns about distracted driving,” Wonder said.

I love it when two-bit Mussolinis betray themselves with the passive voice. "Mistakes were made." Uh huh. What "concerns", and who expressed them, and why, in the land of billboards and flashy public advertisements, does this particular sign constitute any more a threat than usual? In Kali the tyrants don't have to explain.

There probably is some sort of height ordinance or sign ordinance regarding a size limitation.

Most towns have height restrictions in their zoning laws.
I know the town I live in does.
We also have sign size limitations. That is why 90% of the political yard signs are all the exact same size.

A new restaurant remodeled an old establishment in a town near by. They had a road side sign that exceeded the current zoning limits. However, because the previous places sign had been there since 1960 it was grandfathered. When they rebuilt the place they left up the old sign until they had a new one to replace it at the exact same height. IF they had taken down the old one for even ONE day, the town would have told them to make the new sign much smaller and shorter so that it met current zoning restrictions.

I guess the only way to settle if indeed the sign ...“.... was a life and safety issue...” or a 1st Amendment issue is a federal lawsuit.

I did enjoy watching the newly changed 9th Circuit make LA pay the NRA for legal fees on a horrible law they had passed.

It is time for the federal courts to really enforce the constitution.

Sounds like a clear case for a lawsuit for deprivation of First Amendment rights and also criminal trespass to dismantle the sign. That or it's time for California to take down the Hollywood sign, billboards, and all other large signs near roadways.

There ARE zoning rules along most highways. Red States and Blue.

It’s not a first amendment thing. I would put up a BLM sign, watch it remain up, and then sue them.

For a Trump sign, but not a Biden sign. No chance that the latter would be taken down under any circumstances. It could even be in neon and it would never be touched. The political heat would be too intense.
