If U.S. election winds up in Supreme Court, Ginsburg's death will loom large

(Reuters) - The death of liberal Supreme Court Justice Ruth Bader Ginsburg on Friday could spell bad news for Democrats if a legal battle over the results of the Nov. 3 presidential election reaches the high court, as it did in 2000.

If President Donald Trump, a Republican, is able to install a conservative replacement in time, the new justice could help resolve any dispute in favor of the president - an outcome that would deepen the country's partisan divide and threaten the court's reputation as an independent arbiter, some legal experts said.

"People's views of Bush v. Gore would be tame by comparison," said Joshua Douglas, a University of Kentucky law professor, referring to the controversial 2000 Supreme Court decision that effectively handed George W. Bush a victory. "It's almost unimaginable what the reaction would be."....

Nevertheless, Trump and his Democratic challenger, Joe Biden, have assembled sprawling legal teams to prepare for potential post-election court challenges.

Okay, I am too weak and beaten down, I can't take it anymore. I give up. We cannot have a partisan divide in this country. It's just not right, pitting brother against brother, sister against sister. I guess the only rational thing to do, the only nice thing to do, is to vote Harris-Biden and pray to God that there's no problems with this election. I am going to take action now to make sure Trump doesn't install another illegitimate justice. I know it would be illegitimate because I heard it on Al Sharpton's program on MSNBC. The former Attorney General of the United States of America said so. (emphasis on "United"). We need to be United. As that famous and wise prophet for Los Angeles once said, "Can't we just all get along?"

No, eff'n way. We do not give one inch on this. We need to throw every Rat out of office, ridicule and ostracize ever Democrat and RINO. We need another four more years of Trump, hold the Senate, gain the house, add three new conservative, right-wing, completely extremist Supreme Court Justices, and watch the leftist heads explode. I could give a rats ass about partisanship and being divided. I am sick of this uni-party, deep state bull schiff that has destroyed out country. If the left wants partisanship, they are more than welcome to change every fiber of their being and become conservative. Short of that, they can rot in hell.

You have absolutely no way of knowing how these Rinos in the senate will vote. The question is, in a 4-4 vote whether Pennsylvania harvested ballots with no signature will swing PA and the country to Biden, what happens?

Even if Cocaine Mitch can ramrod through a Trump nominee, the Left will scream for the new Justice to recuse themself from any election-related decisions.

Not necessarily.. the oldest one on the bench now is liberal Stephen Breyer, now at age 82.

You have absolutely no way of knowing how these Rinos in the senate will vote.

They will vote the same way they voted for Gorsuch and Kavanaugh who were both confirmed.
And the final vote will take place after the elections. And even Susan Collins (who's election will have been settled), will vote for the Trump nominee.
There will be no 4-4. Period.

The new justice WILL be part of the court in any ballot lawsuits.

If Collins loses she will not support Trump’s nominee. If she wins and Trump loses she will not support his nominee.

McSally and Gardner will vote for the nominee as they need all the base support they can get. Murkowski is a no regardless and Collins May vote yes if forced before the election. Collins will vote No is she loses and vote is after election. Romney? Who the hell knows but probably a No. if Graham loses he will vote No after the election in true McCain style.

Breyer is now the oldest SCOTUS justice at 82 years of age.

He may be the next to go, and I hope it's this year.

Whether she wins or loses, she will support the Trump nominee, same as she supported the other two Trump Supreme Court nominees. The only reason she is hedging her bets right now is because of the elections.

Not necessarily.A tie vote at SCOTUS is the same as a vote upholding the ruling of the court immediately below it...the court which referred the case to SCOTUS.

But with her voting we all know that she would have voted incorrectly...in defiance of the Constitution.

It must be noted that even with all her flaws,she often votes correctly. IOW...as bad as she is she is the very best we can ope for for a filthy state like Maine.
