The late Supreme Court Justice Ruth Bader Ginsburg in 2016 said “nothing in the Constitution” prevents a president from nominating to fill a court seat.
Ginsburg was reacting to the upcoming fight over a replacement for her friend and colleague Justice Antonin Scalia, who passed away. Then-President Barack Obama had nominated Judge Merrick Garland to fill Scalia’s seat only to be denied a Senate hearing by Majority Leader Mitch McConnell.

14 presidents have appointed 21 justices during presidential election years. A half-dozen presidents, classic lame ducks, filled Supreme Court seats even though their successors had been elected.

Scalia didn’t “pass away” as one would describe dear Aunt Hortense’s demise. Scalia was snuffed.....with a pillow.....in his sleep.....by Obama’s hit men. IMHO. No coroner’s report. No post mortem. Hurried burial. All hush-hush. For a justice of the U.S. Supremes? Stinks to the stratosphere!
IEvery time I see that clip of Obama reading the ‘mean tweet’ from Donald Trump on Jimmy Kimmel Live in October 2016, where Obama responded “Hey, @realDonaldTrump, at least I will go down as a president.”, I point and laugh and say ‘a$$hole!’.
President Trump is doing what Ruth would have wanted.

Democrats will take to every media outlet to claim it will be politically dangerous for GOP senators to move a nominee.
The exact opposite is true.
In 2018, 4 D senators lost their seats for opposing Kavanaugh: Heitkamp; Donnelly; McCaskill; Nelson.
