"Donald Trump's campaign lawyer promotes 'birther' conspiracy theory that Kamala Harris is NOT eligible to be VP because her parents were immigrants".
The Trump campaign's Senior Legal Advisor Jenna Ellis pushed a so-called 'birther' narrative Thursday that Kamala Harris isn't eligible to be vice president because her parents weren't citizens when she was born in Oakland, California.
'It's an open question, and one I think Harris should answer so the American people know for sure she is eligible,' Ellis told ABC News.
Ellis' views on the issue came to light after she retweeted a link to a 'birther' op-ed published on Newsweek's website Wednesday written by right-wing law professor John C. Eastman.
Eastman pointed to how Article 2 of the Constitution says only a 'natural born citizen' can serve as vice president and president, but suggests there's some interpretation of the 14th Amendment's Citizenship Clause that could exclude someone in Harris' situation.
He also argued that while the modern view of citizenship includes every person born on American soil, that belief started after Harris was born in 1964. 'Indeed, the Supreme Court has that anyone born on U.S. soil, no matter the circumstances of the parents, is automatically a U.S. citizen,' he also wrote.
Eastman had run as a Republican in 2010 for California attorney general, but lost his primary. Harris ultimately won the position as a Democrat.
Eastman's op-ed received tremendous backlash, with many pointing out that it echoed the conspiracy theory pushed by President Donald Trump and others during President Barack Obama's tenure.
Josh Chafetz, a professor at Georgetown University Law Center, called Eastman's interpretation of eligibility as 'racist nonsense,' in a FactCheck.org post on the controversy.

Didnt stop OBastard.
There is no theory involved. The facts are a matter of public record.
A View of the Constitution of the United States of America - William Rawle (1825)
“Therefore every person born within the United States, its territories or districts, whether the parents are citizens or aliens, is a natural born citizen in the sense of the constitution, and entitled to all the rights and privileges appertaining to that capacity.”
A foreign press weighing in on this issue is absurd.
The former sheriff of Maricopa County, AZ has an opinion too.
“”Nonsense, she was a citizen of the United States from the moment she was born.””
I’m glad I kept reading as I was going to say the same thing. It doesn’t have to be confusing. Her father was Jamaican but she was not BORN in Jamaica so she’s not a Jamaican citizen.
She was born in the United States and IS A CITIZEN of the country she was born in!
I don’t know why the president’s team had to step in it all over again. The country doesn’t need the distraction.
The Dailymail conspiracy weighs in...
But she is patently ineligible.
12th Amendment: "But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States." [1]
Constitution A II,S I, C V: "No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President" [2]
Harris was born to foreign national parents who were both in the country, allegedly on student visas. Donald J. Harris was a Jamaican national [3] and Shyamala Gopalan was an Indian national [4]
Harris was born with Jamaican citizenship. She inherited her foreign fathers foreign citizenship by birthright, regardless of birth location. Jamaican Constitution, Chapter II [5] (a pdf)
The definition for "natural born Citizen" was from a source that is less known today, but was very well known and referenced often in the days of the founders and framers. [6] A source that was not only read from during the Constitutional Convention [7], but the principals from within were used as the legal authority to claim Independence from the crown of Britain in 1776. [8]. Born in country/territory, to citizen parents. [9].
A few months after President Washington was sworn into office, he checked out two books from the New York Society library. One of them was a copy of the very same legal treatise. [10].
The Congress tried to extend the definition to include those born outside the U.S., but again, to two citizen parents, with the Naturalization Act of 1790. (repealed later) [11] Two citizen parents where again key.
The definition was also read uncontested into the Congressional record, on 3 different occasions, by Congressman John Bingham - the father of the 14th Amendment on citizenship. [12]
That Harris is not eligible to be Vice President should be clear to any reasonable thinker and even "amateur" students of the real, recorded history.
Questioning Soebarkah's eligibility was turned into a spectacle of slander and charges of racism, by even most on "our" side. It will be interesting to see if that remains the case this time around.
Has President Trump instilled enough fight back into reasonable Americans that this question of eligibility will be brought to the forefront? Remains to be seen.
Going after Harris on her record is a good idea. So too, is going after her lack of eligibility. This isn't an either or situation. We can, and should, do all the above.
If we care about the Constitution, if we care about original intent, it's crystal clear that Kamala Harris is not eligible to be Vice President.
Was this raised in 1968 when George Romney (born in Mexico) was a serious candidate for the GOP nomination?
No, it was not.
We have to focus on that but we MUST enforce the
Constitution or we have already lost.
That is so correct...caused my eyes to roll when I read the headline.
The concept may have some legitimacy, but will only provide ammo to the the Trump hating RINOs and the left wing nutters.
They are going to give illegals everything why not the VP spot!
That's the requirement for Reps and Senators.
"Citizen."
For President, the framers required a "natural born Citizen" post grandfather clause.
There would be zero (0) reason for a grandfather clause if the requirement were only "citizen."
The framers and founders were not idiots, they knew the distinction ...the people who love our Constitution in our time shouldn't be either.
Probably the best test of “natural born citizen” is that you cannot possibly be anything else.
If you are born in the USA with two parents who were citizens their entire life, there is no possible way you can be a ‘natural born’ citizen of any other country.
Kamala’s parents were not citizens, were they? So she is their anchor baby, right? She COULD BE a citizen of Jamaica or India. Or a dual citizen. = NOT ELIGIBLE
I don't know, you tell me...............
that I will bear arms on behalf of the United States when required by the law
Do you really want to go there when the conversation turns to military deferments?.....
Give it up dude........
You're simply echoing the same arguments that were posted here during the McCain years and Obama............All of which were nothing but a bullshit wast of time...............
Been there and done that and not wasting any more time on this crap.
She not the only one questioning. Here is a Newsweek article from yesterday.
https://www.newsweek.com/some-questions-kamala-harris-about-eligibility-opinion-1524483
“Her father was Jamaican but she was not BORN in Jamaica so shes not a Jamaican citizen.”
She might be a Jamaican citizen, that is a matter of Jamaican law. Her natural born status is not affected by other countries law.
Why would I sue?
I’m not running for President, and I wouldn’t take the job if you gave it to me.
Bingo!! Although this is a legitimate question, the leftwing DNC press would love it if focus is on "birther" issues. They will gladly talk a lot about the "birther" question to take the focus away from the ton of problems with Kamela on policy, past history, and extreme liberal ideology. This strategy worked when the leftwing press was helping Barry win his elections. Cover up real issues with the "birther" question and then discredit or dismiss it for those voters who are not paying too much attention.
Mr. Trump, during his initial press conference after the selection of Kamala, focused on her mean and nasty behavior during the Kavanaugh hearings, and also on her far left wing ideology.
We will be wise to focus the public's attention on Kamala's failed ideology and her corrupt Cali politics, her history as a prosecutor.
