The petition was made from Sullivan through Wilkins (or whomever the objecting judge of the appeal was). By 7/24 the DOJ, Flynn, or both parties need to reply with reasons against en banc. If the majority of judges see no need for en banc, the en banc is rejected and the appeal court’s decision to end Flynn’s case is enforced. The majority of the court is Dem noms, but en banc in this case would look very biased so I think they drop it.

The original deadline for this was 7/15.

Don’t count on it the appeals court just told Flynn’s team they had 10 days to respond which means they are going to hear the case, the DC appeals court is a liberal bunch of Trump haters!! Trump needs to pardon him NOW enough of this BS!!!

I had not heard this, does not sound good. I would think if they decided against it they would have said so by now.

I am happy for Stone. Apparently he resisted the temptation/pressure to turn on Trump — unlike Michael Cohen. He was treated badly only because he was associated with Trump. I heard he ended up broke, too, and was gagged from defending himself publicly. I am glad Trump came in and pulled him out of the swamp at the last moment.
