The Supreme Court ruled Wednesday that the Trump administration acted within its authority when it expanded exemptions to the Affordable Care Acts requirement for employers to provide insurance coverage that includes contraception.

On Wednesday, the court released opinions in the following cases: In Our Lady of Guadalupe School v. Morrissey-Berru, the justices held that employment discrimination suits by female teachers fired by Catholic elementary schools are barred by the First Amendment's "ministerial exception." In Little Sisters of the Poor v. Pennsylvania, the justices upheld a federal rule exempting employers with religious or moral objections from providing contraceptive coverage to their employees under the Affordable Care Act.

Everyone please remember the Sisters in your charitable giving. They’ve had to contend with immense legal bills due to this type of harassment by our state’s AG, as well as the increased expense of protecting residents in their facilities from the China Virus.

Kagan, who was in the majority, expects the Trump rule to be challenged on procedural grounds and expects the administration to lose in the lower courts.
The APA has been Trump's Achilles' heel and may be again.

Beginning at Part III on page 22 of the Opinion, the Court rejects the argument that the rules at issue were promulgated in violation of the APA.
