The decision by the appeals court I found very persuasive. Basically it pointed out that it is not the job of the courts to go out and identify people to charge with crimes. That is a good thing.
The parties here are the petitioner, Flynn, and the respondent, Sullivan.
Ill believe it when Sullivan issues his order to dismiss.

Powell said something about the agencies moving money off the books, billions, and that Flynn was going to audit them so they went after him.
I think you missed that part: since the investigation wasn't done in good faith, they've lost qualified immunity.
So YES, they can be personally sued and I hope General Flynn does just that.
thanks for the link ... amazing opinion, completely destroys sullivan’s illegal actions and completely dismantles his bogus response to the appeals court regarding the mandamus request ... this opinion is also a powerful addition to case law that will pretty much end all such shenanigans of activist judges to stick their noses into dismissal of cases by prosecutors ...
the other thing the opinion made clear that i didn’t really understand beforehand, was that sullivan and gleason were ultimately trying to tie the DoJ into knots indefinitely by forcing them to defend themselves against an infinite and unending tsunami of accusations about this case and any other cases they so chose to attack ...
this is a gigantic win for the rule of law, separation of powers, and the U.S. Constitution, and would NOT have occurred without judge Neomi Rao, who was appointed by President Donald J. Trump.

Judge Sullivan seems incredibly fixated on Flynn, and considering his previous attacks on Flynn and his obsessive persecution of the man, I would not be surprised to see him continue his vendetta.
Sullivan doesn’t actually have to do anything, and can still win this. Judge Wilkins, the dissenting judge, or any other active judge on the DC Circuit can sua sponte request en banc review. If en banc is granted, Sullivan pretty much wins, even if he loses. The case would be tied up, effectively until the election. The en banc review would likely reverse the panel, forcing Trump to pardon Flynn.
At this point, I think the only likely options are to follow the order or seek en banc review. No way this goes to SCOTUS.

SCOTUS will say, “Yes. Now.” Lawyer will send Flynn his bill.
Question for anyone who knows....
Does this mean the DOJ will no longer have to produce any remaining hidden documents?
Those documents could further demonstrate why Flynn is entitled to tens of millions of dollars in damages.

Even if Trump wins, the investigations will go on forever, with no little help from the likes of McConnell, Graham, equivalents in the House, even Gowdy-type.
We will never see anybody be hauled and held responsible for any wrongdoings during Obama’s reign.
