Before being shot to death by an Atlanta police officer in the parking lot of a fast food restaurant, Rayshard Brooks had a cordial conversation about being in the area to visit his mother's grave and to celebrate one of his young daughter's birthdays, according to a series of videos released by officials.
The shooting of Brooks, who is black, on Friday night sparked new protests and an arson fire at the Wendy's where the confrontation started and escalated into the use of lethal force. It came on the heels of days of protests in Atlanta and across the nation over the officer-involved killing of George Floyd in Minneapolis.
Initial autopsy results released Sunday evening by the Fulton County Medical Examiner said that Brooks died from two gunshot wounds to his back that "created organ injuries and blood loss," and that the manner of death was a homicide.
The fatal episode led to the resignation of Atlanta Police Chief Erika Shields on Saturday, the firing of the officer who shot and killed Brooks and the other officer involved being yanked from the streets and placed on administrative leave.

By evading capture and resisting arrest while firing on the cops, he mortally endangered the cops and violated their civil rights.
When the resistance to arrest began, his personal rights were forfeited. The cops right to safety and basic civil rights become superior to those of the resister

You are right, the guy was not in custody but was in the process of being taken into custody when he grabbed the taser gun.
There is video showing the perp pointing the taser at the cop and zapping him. However, it was evidently not a huge hit as the cop, temporarily set back, gained ground and continued chasing the guy until the other cop shot and killed him.
This is a confusing case to me.
I dunno, shooting someone three times in the back .....it seems an over-reaction. And don’t forget they had the guy’s car.
But I don’t want anybody pouncing on me and telling me cops should be allowed to shoot people in the back, damn such as judges and juries.
However, I saw the perp tase the cop and that shouldn’t be allowed.
People say the perp stole a weapon from the cop. Well suppose the cop’s “weapon” was a night stick? A flashlight?
Is there any limit to when a cop can shoot a running criminal in the back?
Bear in mind, I don’t know the answers. I was once married to a cop. It’s been a while but I don’t think he would have shot a guy in the back for such a thing.

Rayshard got early parole because of Covid 19
Rayshard broke the terms of his parole and did not want to go back to jail.
Rayshard resisted arrest because he did not want to go back to jail.
How do we put folks with a criminal mind back in Jail!!
It looked like the taser shot at Rolfe hit him? After Brooks fired the taser, Rolfe ran into a car then staggered for a few steps before firing...am I seeing this right?
Kinda immaterial at this point if it did or didn’t hit him. It was a justified shoot within department policies, and the DA is openly talking about murder charges. Hopefully the cop gets a half decent labor attorney as well as one to sue the city as well.
The REAL cause of death was complete stupidity.

I am waiting for confirmation of Brooks’s record. I don’t know if it’s real- but if so, not one news organization is releasing it.
