A federal judge said Tuesday that he would allow interested parties to weigh in on Michael Flynn's case, an unusual move for a criminal prosecution, after the Department of Justice (DOJ) sought to drop the charges against the former national security adviser.
Judge Emmet Sullivan of the D.C. District Court said in a brief order that "at the appropriate time, the Court will enter a Scheduling Order governing the submission of any amicus curiae briefs."
The case was upended last week when the DOJ moved to dismiss its charge against Flynn for lying to the FBI about his conversations with the Russian ambassador to the U.S. in 2016.
ADVERTISEMENT The lead prosecutor on the case, who had been overseeing it since Flynn first pleaded guilty to the charge in 2017, withdrew shortly before the motion was filed last Thursday.
It's unusual for prosecutors to withdraw a case against a defendant who has already pleaded guilty. The move to allow amicus briefs offers critics of the DOJ's decision an opportunity to weigh in.
Sullivan, a Clinton appointee, still needs to approve the DOJ's motion to drop the charges. He has yet to schedule a hearing or ask for further briefing.

Obozo pressured him with his timed “leaked” (planted) private phone conversation to news media the obozo alumni association about the “rule of law” last week. Obozo could not call the judge on the phone - that would have been worse than say Loretta Lynch having a (not so) secret meeting at an airport with BJClinton to discuss their grandchildren.
SUllivan had the DOJ do this to him in the Ted Stevens case, and he was not happy. You would think he would have hauled the newly resigned DOJ prosecutor before him today and hold him in contempt. Then again, he is a Clinton appointee, he may be in fear of his life. Meanwhile CJ Roberts believes his judiciary is apolitical.

Ive been saying for months that Flynn has one serious problem here. I order for Flynn to get out of his plea deal he had to admit that he stood up in court and lied to this judges face at least twice.

Sullivan is going to sentence Flynn and it won’t be overturned before the election.
The proper response to all this is hammer the FIB/Deep state now. Release everything. If documents are missing let’s have Wray explain that one.

This is an obvious shout out to Obama and Holder Hey what do you want me to do now?
Barr better hit back hard, and send a friend of he court brief that now adds a lot of things they didnt say originally, about how all these agents were fired, are now being criminally investigated, etc. And they need to release it ASAP.

A Writ of Coram Nobus is a long held writ, dating back to the middle ages, and English Common Law, which is filed, even if the case is over, and the person is out of jail. It is also known as a Writ of Error, to correct the record. It is what the DOJ should have filed to dismiss the case against Flynn. Moreover, within such a writ, it should be pointed out the criminality of all those whom have committed this fraud upon the Court, IMHO.

Once appointed to the bench, no judge has to worry about accountability. The House never impeaches even the most outrageous federal judges. Even if a future GOP House were to develop the backbone to impeach a leftist judge, the Senate will never get a supermajority to convict and remove.
Consider all the leftist judges appointed to the bench under the Clinton and Obama administrations. The moderate Republicans in many case voted “yes” on the premise the president was entitled to his picks. Was there reciprocity from the Democrats during the Reagan, two Bush, and Trump administrations? No, almost every conservative judge received a rabid opposition from the Democrats and the media. Hence, many of the Bush appointees were moderates who shifted left once comfortably in a lifetime appointment. What did McCain, Graham, and other GOP moderates say about the Democrat hypocrisy? Silence.
As long as Congress fails to do its job, every appointment to the federal bench is critical. When judges knowing flout their oath to uphold the Constitution, we do not have rule of law.

Interesting development just in the Flynn case. Judge Sullivan just issued an order saying “at the appropriate time, the Court will enter an Order governing the submission of any amicus curiae briefs.” That certainly does not suggest quick order granting an unopposed motion...
...due to the controversy, Flynn opted not to be sentenced by Sullivan at that time. That left him unsentenced, which ironically made this motion easier. Otherwise, Flynn would have faced a more difficult post-conviction motion while on appeal. No amicus can change that record...
Amicus can certainly add more heat but not light. More importantly, it is unlikely to change the outcome. I previously stated that I thought Judge Sullivan would call a hearing. This appears to confirm that he is unlikely to go quietly into the night with a ruling on the papers.

She has to be very careful with her public statements in this case, especially now.
I am wondering if her appearance on television this weekend past was a tactical error when she made it clear that her client’s case goes all the way to obozo. Judge probably noticed that. Clinton-appointed Judge has in the past displayed a negative opinion towards Flynn, which he was forced to walk back quickly. And obozo via his pals in the “media” last friday delivered a message to the judge about should be done in this case.

It looks like the judge wants to give former DOJ employees (2,000 signatures on letter) an opportunity to publicly undermine and undercut the position of the DOJ in moving to dismiss the charges. Infuriating, remarkable and transparently political.
Judge Sullivan even cited famously political Judge Amy Berman Jackson, a subtle hat/tip to President Obama’s recent May 8th instructions. Sullivan’s order can put to rest any contemplation of him holding corrupt prosecutor Brandon Van Grack to account; and only further delays removing the sword of damocles from atop Lt. General Michael Flynn.
The transparent purpose of allowing public comment, specifically from the Lawfare resistance group, is to undermine the DOJ and further create a political narrative around AG Bill Barr. However, on the positive side this might stir Barr to release even more damaging information to counter the political efforts of Judge Sullivan. Quite remarkable.
