A federal judge said Tuesday that he would allow interested parties to weigh in on Michael Flynn's case, an unusual move for a criminal prosecution, after the Department of Justice (DOJ) sought to drop the charges against the former national security adviser.
Judge Emmet Sullivan of the D.C. District Court said in a brief order that "at the appropriate time, the Court will enter a Scheduling Order governing the submission of any amicus curiae briefs."
The case was upended last week when the DOJ moved to dismiss its charge against Flynn for lying to the FBI about his conversations with the Russian ambassador to the U.S. in 2016.
ADVERTISEMENT The lead prosecutor on the case, who had been overseeing it since Flynn first pleaded guilty to the charge in 2017, withdrew shortly before the motion was filed last Thursday.
It's unusual for prosecutors to withdraw a case against a defendant who has already pleaded guilty. The move to allow amicus briefs offers critics of the DOJ's decision an opportunity to weigh in.
Sullivan, a Clinton appointee, still needs to approve the DOJ's motion to drop the charges. He has yet to schedule a hearing or ask for further briefing.

We have juries in this country, but trial by “interested parties”.
The judge wants to pretend he didn’t have any idea this was a travesty, which means trying his best to keep going! If he doesn’t agree, I predict Trump will pardon immediately based on wrongful prosecution.

He’s also hoping to delay everything until after the election.
This stunt puts to rest the idea that the good judge was about to come down hard on DOJ for prosecutorial misconduct. That was never in the cards.

That occurred to me, but I am not an attorney. Given that the standard is evidence of an actual crime beyond a reasonable shadow of doubt, and the DOJ has admitted that there was no actual crime, and that Flynn as railroaded it seems to me that he is in a narrow box.
Trump HAS TO pardon Flynn before the election.
The country will never be the same. Not with these enemy forces being exposed and I see that as a good thing.

Didn’t the Supreme Court just vote 9-0 against bringing in outside opinion?, that both the plaintiffs and defendents had to stand on their own case?
