Grassley to DOJ: It's Time to Unseal Michael Flynn's Case Documents

Former Senate Judiciary Committee Chairman Chuck Grassley sent a letter to Attorney General Bill Barr this week asking for transparency and sunlight regarding General Michael Flynn's case. Flynn's attorneys have accused the government, specifically the FBI, of engaging in prosecutorial misconduct against him.

"This is no ordinary criminal case. One of the agents who interviewed Lt. Gen. Flynn, Peter Strzok, was later removed from the Russia investigation after his texts demonstrating animus and bias toward the President were discovered. Additionally, former Director McCabe was fired for lack of candor regarding a leak to the Wall Street Journal, and Lt. Gen. Flynn was an adverse witness in a pending sexual discrimination case against Mr. McCabe at the time Mr. McCabe was supervising an inquiry targeting Lt. Gen. Flynn," Grassley wrote. "Further, the Flynn case was at the center of a political firestorm over the President’s alleged statements about it to Director Comey. Moreover, Flynn himself 'had told both White House Counsel and the Chief of Staff at least twice that the FBI agents had told him he would not be charged,' which is consistent with what Director Comey told me and my staff. The FBI’s conduct is ripe for congressional oversight."

The FBI agents who brought the case against Flynn for allegedly lying to investigators have since been fired for rampant misconduct and abuse of power.

"After years of rampant speculation and publicly reported inconsistencies regarding how the FBI handled the case, it’s time for the public to know the full set of facts relating to Lt. Gen. Flynn, including any and all government misconduct. In light of the extraordinary public and congressional interest in this case, I request that you work with Flynn’s attorneys to unseal these new records provided to them so that the public can access the material," he continued. "In the alternative, I request that you amend the protective order so that Congress can review the information in light of its constitutional oversight prerogatives."

Flynn's top attorney, Sidney Powell, said earlier this week DOJ is working to release the documents. She has repeatedly argued the case against Flynn was a set up, that he was coerced into a guilty plea and that his situation presents a clear double standard of justice.

I’m cynical....

I wonder if Barr isn't ready to talk around December, 2020 after a certain election is safely over for interested Deep State insiders. Then "What? Do all this messy indictment stuff during our happy family oriented Christmas week?"

Then news headline: Retirement from the DC fray looks better and better for Barr and other Trump people who now face replacement by Dem President. New AG Nominee Was College Pal of AOC.

You need to read the language of Flynn's plea deal.

The judge asks specific questions to the defendant like...

Are you pleading guilty just to get a lighter sentence?

Are you pleading guilty because you cannot afford an attorney?

Do you understand that you are entitled to a formal trial and a judgment by a jury of your peers?

Flynn probably lied on half a dozen questions or more that will have relevance to a civil lawsuit or prosecutorial misconduct.

When is the last time you heard about a federal defendant overturning his own guilty plea?

Not often!

Did General Flynn lie?

With the full weight of the Department of Justice conspiring and conniving with Flynn’s own lawyers to frame him?

Nahhh. Why would he lie.

There is a key legal problem.

Indeed. There is also a key justice problem that fatally taints the entire case. He was framed by the FBI, aided and abetted by the DOJ and his legal counsels. That is why he fired his lawyers and retained Sidney Powell who is destroying the people you are making the same arguments that you have just made. He will be pardoned, if required; but, he should be exonerated in view of his clear innocence and the egregious criminal handling of this case by the FBI, the DOJ, and the Covington law firm.

Why are they sealed in the first place? There is no national security issues here.

The very idea these documents will vindicate the General and expose the intense levels of criminal actions that Obama's DOJ went through to threaten and frame Flynn is far greater than any petty "national security issues".

DOJ/FBI frame/threatened rather than former Law Firm? Sounds like Covington failed represent/may have colluded w DOJ though.

Judge Sullivan has issued a minute order that requires Flynn’s former Law Firm to conduct a search and provide to his current legal representation any documents:

“The federal judge presiding over retired Lt. Gen. Michael Flynn’s case issued a surprise order telling the former national security adviser’s previous attorneys to conduct another search of their entire case archive after it was revealed they failed to turn thousands of documents over to Flynn’s new defense team.”

“The ruling by Judge Emmet Sullivan was made public Tuesday afternoon after Robert Kelner and Stephen Anthony, Flynn’s former lawyers at the powerhouse firm Covington & Burling, claimed there were 6,800 records they had only just now unearthed and turned over to Flynn’s current defense team, which has been led by former federal prosecutor Sidney Powell since July 2019.”

““It is FURTHER ORDERED that Covington & Burling LLP shall re-execute a search of every document and communication pertaining to the firm’s representation of Mr. Flynn,” stated Sullivan’s ruling, which appeared on the public docket. “It is FURTHER ORDERED that Covington & Burling LLP is FORTHWITH DIRECTED to produce to Mr. Flynn’s successor counsel all documents or communications concerning the firm’s representation of Mr. Flynn that were not previously transferred in the rolling productions. It is FURTHER ORDERED that Covington & Burling LLP shall file a notice of compliance with this Order by no later than 12:00 PM on May 4, 2020.””

Note that they are required to CERTIFY that they have produced all relevant documents.

FOR THIS REASON, WE AND FLYNN do NOT want them to unseal the DOJ documents UNTIL Ms. Powell Esq. has received the Covington documents and Judge Sullivan the certification he demanded. Covington & Burling needs to be kept guessing about these documents because they do NOT want to be in a position where they failed to supply common or related documentation supplied by the DOJ and to be found NOT in compliance with Judge Sullivan’s order. Let them SWEAT IT OUT!

After May 4th, next week, DeClass away!
