The federal judge presiding over retired Lt. Gen. Mike Flynns case issued a surprise order telling the former national security advisers previous attorneys to conduct another search of their entire case archive after it was revealed they failed to turn thousands of documents over to Flynns new defense team.
The ruling by Judge Emmet Sullivan was made public Tuesday afternoon after Robert Kelner and Stephen Anthony, Flynns former lawyers at the powerhouse firm Covington & Burling, claimed there were 6,800 records they had only just now unearthed and turned over to Flynns current defense team, which has been led by former federal prosecutor Sidney Powell since July 2019.
It is FURTHER ORDERED that Covington & Burling LLP shall re-execute a search of every document and communication pertaining to the firm's representation of Mr. Flynn, stated Sullivans ruling, which appeared on the public docket. It is FURTHER ORDERED that Covington & Burling LLP is FORTHWITH DIRECTED to produce to Mr. Flynn's successor counsel all documents or communications concerning the firm's representation of Mr. Flynn that were not previously transferred in the rolling productions. It is FURTHER ORDERED that Covington & Burling LLP shall file a notice of compliance with this Order by no later than 12:00 PM on May 4, 2020.
Around the same time Tuesday afternoon, a seven-page filing from the Covington attorneys was unsealed, which showed that Kelner and Anthony had just transferred thousands of documents that they had been sitting on for almost a year to Powell and Flynns new team. Earlier in April, Covington admitted it failed to transfer a number of emails and two hand-written notes over to Powell, but Tuesday showed that this was just the tip of the iceberg.
Covington has now re-executed the email collection and searches on the broader set of emails,

Delay tactic? Absolutely! Why? Because while Flynns case is tied up in court, other related cases of the real perps cant move forward.
If the judge had already done the right thing he would NOT have caught the shysters in their illegal acts and they would never be brought before the bench for malfeasance! Im glad its happening soon but also glad it happened later to point out the corruption of the DC law firm.
Bingo... It’s very frustrating.

Im thinking theres a treasure waiting at the end of this for Flynn and Powell. Is this a first for Mueller? I know hes been dirty for a long time, but conspiring with the defendants attorneys.”
Covington, this is where Eric Holder worked too, same law firm, go figure. Wonder if he was good buds with these shysters and was emailing them advice?

If I had to bet, that would be the way I bet.

I am missing the point.
Please expand on that.

So ... what happens if they dont find anything?

looks like former defense team just “turned up anotehr 6,800 documents”
smells like they were in on the sting along w/ DOJ & Fibbers. all crooked?
How would she get her hands on such documents, and why would she need to ask for them if she already had them?
Never know what little birds can drop off at your doorstep and fly away...
Why ask for ALL documents? So she gets Covington to certify to the judge that they complied, then she lowers the boom.
May not be much of a tactical advantage in the criminal case but I would think the civil case ($$$) would be worth something.
It appears to me that the Judge is prepping the groundwork to declare Gen. Flynn's previous counsel incompetent in his defense which lays the groundwork for the Judge to throw out the plea agreement. That may then result in the Judge issuing a summary finding of not guilty for Gen. Flynn and end this whole fiasco.
That would be justice and IIRC enable Gen. Flynn to sue the piss out of everyone involved in attempting to frame him, and also sue his former counsel for not representing or counseling him appropriately.
(Note: I'm not a lawyer and ain't good enough looking to play one on TV.)
Dont forget about Esq. Brady. Im waiting for shoe #2.

She has some, but those she has refer to documents that have not been handed over which under Brady must be. . . yet they claim these referred to documents just dont exist. But if theyre referred to in extant, already produced documents, the they prima facie exist. So, hand them over and quit playing games! Each time Powell goes back to court she shakes more of these "non-existing" documents loose, which the prosecution they swears "thats all there is,Your Honor, cross our lying hearts, there are no more!" But they still dont include a lot of the already cited documents that she has in other produced docs, and the newly produced stuff always shows theres even MORE theyre hiding! Then, other cases evidence show they have even more they havent released that was exculpatory to Flynn. . . and its nowhere in what theyve produced! Ever!
Now the question arises "did the prosecution actually give the exculpatory evidence to Flynns former attorneys, i.e., Eric Holders law firm, and was it buried for political reasons?" Now there are serious ethical questions for his former attorneys. Did they have it and not use it because their senior partner, Eric Holder, ordered them not to?
Rhetorical question: How rich is Mike Flynn gonna be when the smoke clears?
My understanding is that Flynns old lawyers are stalling because he refused to pay their final bills after he hired Powell.
“So ... what happens if they dont find anything?”
They’ll have to swear on it, and then hope to hell no one breaks the lie.
Are you sure there is no reason, or just a reason you don't want to consider.
Maybe he is just basing it on the judges previous decisions in this case. If I remember correctly everyone here just knew the judge was going to throw this case out the last time his lawyer presented her evidence. This Judge hasn't treated Flynn any better than Stone's judge.
She has copies of the DOJ’s end of the conversation, given to her by Jensen and Shea.
