Federal judge indefinitely postpones sentencing of Michael Flynn

A federal judge on Monday indefinitely postponed the sentencing date for President Trump’s former national security adviser Michael Flynn on charges of lying to the FBI in the Russia investigation.

The move by Judge Emmet Sullivan comes a day after federal prosecutors filed a rare Sunday motion to delay a number of approaching deadlines that would ultimately make Flynn’s Feb. 27 sentencing unlikely. The delay also comes weeks after Flynn withdrew his guilty plea.

In their filing, prosecutors argued that Flynn’s former attorneys should testify after he claimed to have received ineffective assistance from them. Flynn had previously hired the premier D.C. law firm, Covington & Burling. Federal lawyers also asked the judge to order that Flynn has his attorney-client privileges in his communications with Covington & Burling waived.

Based on recent FISA court ruling, I believe the DOJ lawyers hope that the whole Flynn prosecution is declared “fruit from a poison tree” and the case dismissed. The DOJ will state that now don’t have to provide any more information to the defense as it would be moot.

Judge Sullivan is an odd duck. I don't think anyone knows what he is going to rule. At some points in the proceedings he's been very hard on Flynn. At other times he's seemed hard on the Prosecution.

It sure looks from the outside like the DOJ's case is discredited, but here we are. The judge has been able to see that for months, but he hasn't done anything to help the defense in that time.

In fact, sort of the opposite.

Is he still being held in custody? If so he ought to be released and at the worst ordered to in home detention with a couple of hours a day to get out and shop, walk, etc.

My guess is after the election Flynn will get a full pardon and maybe his legal fees reimbursed.

I repeat again, because it never gets reported, that Flynn has been and will be under a Gag order until this gets resolved. Flynn has not been allowed to speak publicly for over two years now, with no end in sight. The deep state has very effectively shut him up.

It is disgusting, and it seems to me, un American. He no opportunity to publicly defend himself and his reputation.

I kinda like the idea. Of course, it must be coupled with government attorneys being placed under oath on several topics including Brady evidence.

Was the Flynn prosecution at all based on FISA ? (not disagreeing w/ you, but I don’t know.)

Hm, the Brits are kicking the can on when to have extradition hearings for Julian Assange too. I wonder if the Brits and Judge Sullivan are waiting to see what Durham uncovers before acting.

Flynn has never been held in custody. His was not given the Roger Stone "SWAT Team arrest" treatment, he hired a white-shoe Washington law firm, and was arraigned by agreement with the DOJ.

He was a 70 year old man kept in solitary confinement. Most tax cases spend their short time in club fed. What was done to him was disgusting.
