Rep. Seth Moulton tells military to question Trump's orders

A lawmaker who earned the Bronze Star during combat in Iraq as a Marine officer is denouncing President Donald Trump's foreign policy as "rudderless," and calling on active-duty military officers to question the orders they're getting from the commander in chief and refuse to follow them if they're not lawful.

Rep. Seth Moulton, a Massachusetts Democrat and former presidential candidate who ended his White House bid in August, made the remarks in a speech at the Atlantic Council on Thursday, a day after Trump triumphantly addressed the nation and announced that Iran seemed to be backing down from hostilities.

You know Joe LIEberman used to tell US he was an Orthodox Jew not just a conservative one! Joe Lieberman’s excommunication
Toward the end of the presidential campaign, a rabbinical court in Brooklyn excommunicated Joseph Lieberman for causing “grave scandal” to the Jewish religion by “falsifying to the American people the teachings of the Torah against partial birth abortion,” as well as by claiming that Jews can marry non-Jews without violating the tenets of Orthodox Judaism. Another count was his “legitimizing homosexuality,” which the Torah “strongly condemns.”

“What was the Bronze Star for?”

The Bronze Star is used instead of the Meritorious Service Medal in combat zones. So unless there is a “V” with the Bronze Star it could very well be for “Fetching the General’s martinis In a combat zone”

The part about questioning an order better happen AFTER the order is carried out or else someone has stepped in deep doody and it ain’t the person who issued the order.

In Basic Training you are instructed regarding war crimes to "Repeat the order, Refuse the order and Report the order."

If you think the order was unlawful you should be prepared to defend your insubordination in a court martial and accept the consequences if you are wrong. You accepted your obligations under oath at the time you entered military service. The military is not tolerant of clever and frivolous remarks.

“refuse to follow them if they’re not lawful”

Isn’t that always true?

I had read only the excerpted passage in this thread, so I went back and read the entire article. Mouton does not argue that the order to take out Soulemeni was illegal, although he does argue that it was ill-advised.

Fine, that’s his opinion. An officer has a duty to follow orders which he may consider to be ill-advised but has a duty to not follow illegal orders.

Personally, I have no problem with the decision to eliminate Soulemini. Should have been done years ago.

I note that you wrote that an officer has to follow orders given by the Commander-in-Chief, and you did not mention any equivocation. Again, I ask, how did that work out for the Nuremburg defendants?

So he lied in his oath to uphold the Constitution and “obey the orders of the President of the United States and the officers appointed over me.” Typical Democrat.

It’s been 59 yrs+ since I went thru BT but I am sure we were told to follow all “lawful” orders which sort of goes to what you are saying but I am also sure we were told we may not question an order until after we carried it out.

Perhaps this last refers to routine orders such as being put on KP every weekend and questioning the fairness of the order or something along those lines.

Frankly trying to remember 60 yrs ago is a stretch.

Immoral orders MUST not be carried out. What good would it do to question an order after civilians are massacred? (Or other such immoral order)

I think “immoral” is a bit to ambiguous.

[From the article]

“And for those members of our military in the chain of command, here in Washington or overseas — look very carefully at every order given to you by this president,” Moulton said. “It is our duty to make sure everything done in the name of the United States military is lawful; and that burden falls on us. ... We have an opportunity to call on our military officers around the world to bring new scrutiny to their sworn oath to obey lawful orders, and only lawful orders.”

While you are correct that Moulton is not explicitly saying that he thinks the order to kill Souleimani was illegal, he is certainly implying, rather strongly, that EVERY ORDER given by Commander-in-Chief Trump is suspect, and thus must be “look[ed at] very carefully.”
