A federal judge on Monday rejected Michael Flynns attacks against the FBI and the Justice Department, setting a long-delayed sentencing for President Trumps former national security adviser for Jan. 28.
U.S. District Judge Emmet G. Sullivan of Washington, D.C. dismissed Flynns motion to find prosecutors in contempt. In a 92-page decision, Sullivan ruled there was no basis for Flynns allegations that federal law enforcement officials entrapped the retired three-star Army general into accepting a plea deal and that special counsel Robert S. Mueller IIIs prosecutors had not wrongfully held back 50 requests for evidence from Flynns attorneys.

He wants to visit his family there for Christmas. He did it last year, too, and will be back in time for his next court appearance. No need for house arrest here.
There was no FISA warrant on Flynn.

No one needed a FISA warrant on Flynn because we were already (legally) monitoring the Russians that he talked to.
No one is claiming there was a FISA for Flynn and the FBI never cited any evidence from FISA surveillance.
Give him one day.
Im not sure it could happen until after sentencing either.

Also the Page FISA is a foreign influence warrant meaning any person Page bumped into in the hall can have surveillance against them. this is not a normal FISA it's a section 702 which are rarely given out
You got the facts wrong. Powell stated more than once she would want the Brady materials first, then she would withdraw.
Yes, many ARE tainted.
The argument Powell made was legal nonsense. The only way to “work with” a guilty plea is by addressing it head on, which she did NOT do. That makes her a very bad lawyer or something worse than a bad lawyer.
Powell made grandstanding statements about Brady, but she did NOT analyze Brady, especially in light of the guilty plea, something the judge pointed out.
If Flynn is given months of incarceration, as I hope he will not but suspect he will, then Powell will be entirely responsible for the incarceration because of her reckless and legally sloppy “work.”
If Powell is incarcerated when he had already been promised no incarceration, how good will Powell’s ostentatious “defense” of him have been?
I saw Powell herself state she had no intention of moving to withdraw the plea. I have no idea what you saw.
And her legal argument was not an actual legal argument anyway, so the plea was never going to be addressed. Her “argument” was grandstanding, and apparently included an unethical cut and paste plagiarism.
Her Brady argument never analyzed the circumstances beyond the grandstanding, as Sullivan demonstrated in minute detail.
But the real outrage is that she turned Flynn into an unrepentant liar, who now will be sentenced as such.
People (like me) who support Flynn ought to be outraged at Powell, but instead they are lauding her for screwing him royally.

Moving to have a case dismissed is NOT the same as moving to withdraw a plea. That is a distinction which made Powell’s motion nonsense.
Correct. They are not the same. Asking for dismissal is a better option and withdrawal has the risk of a lengthy trial.
So the strategy can be: Brady first, then dismissal. If failed, withdrawal. Sounds very logical to me. They should not play both dismissal and withdrawal games at the same time.
