Flynn Sentencing Scheduled for Jan 28th

A federal judge on Monday rejected Michael Flynn’s attacks against the FBI and the Justice Department, setting a long-delayed sentencing for President Trump’s former national security adviser for Jan. 28.

U.S. District Judge Emmet G. Sullivan of Washington, D.C. dismissed Flynn’s motion to find prosecutors in contempt. In a 92-page decision, Sullivan ruled there was no basis for Flynn’s allegations that federal law enforcement officials entrapped the retired three-star Army general into accepting a plea deal and that special counsel Robert S. Mueller III’s prosecutors had not wrongfully held back 50 requests for evidence from Flynn’s attorneys.

Judge Sullivan was appointed by Ronald Reagan to the D.C. Superior Court in 1984. Bill Clinton elevated him to the D.C. federal court in 1994.

The judge thinks that Trump maybe removed by then in which case, Flynn would not be receiving any pardon from mike pence....that is my guess.

Powell has done grave damage to Flynn, making him look like a liar and unremorseful. That damage cannot be undone in any way, and may in fact lead to substantial incarceration when probation was originally promised.

Can't wait to read Powell's reaction.

How about all the Freepers that have been calling us #NeverTrumpers for doubting that anything will happen to anyone of importance unless they are Republican.

We just knew the Judge would through this out and lambaste the Feebs and the DOJ.

Negative thinkers are always right........... or pleasantly surprised.

Powell was grandstanding, not making a coherent legal argument. Flynn was bamboozled.

It will be interesting to see if Powell said to Flynn: “I will be risking your getting substantial incarceration if I make these politicized, non-legal arguments, and in the process you will be giving up the certainty of NO incarceration. Is that OK with you?”

Flynn did NOT ask to withdraw his guilty plea. That was a major indication that Powell’s argument was incoherent, at best.

Sullivan had the weight of the stasi swamp on his shoulders, but that doesn't excuse him from ignoring new evidence which showed Flynn was threatened by these DOJ attorneys into signing the day before the Strzok/Page text scandal broke,

Set up, falsified 302s, threatened with “the Manafort Treatment”, after selling his house and bankrupting hm, taking all civil liberties away. Flynn gave in, signed onto a lie in order to make it end.

Tell me those who ridicule Flynn or his attorney, how would you bear up under the boot of Hitler on your throat?

And ALL this persecution plus years of spying on Flynn because he knows the full story of Obama’s tyranny and planned to end the Intel Community's ability to spy at will upon us, innocent citizens!

Then it sounds like a presidential pardon is Powell’s only option now. That can’t happen until after the election

Disclaimer: This came from another board, it is not mine.

Flynn goes before a compromised Judge (Contreras), using a defense counsel that has a massive conflict of interest and pleads guilty.

The original judge has the case taken away from him.
Nothing is done to Judge Contreras.
Flynn fires his lawyers.
Nothing is done to the lawyers who threw his case.
The IG reveals extreme errors and felonious conduct by the FBI, tainting the case and evidence Mueller used to get this conviction.
Less than a week later, the judge ignores all of this and denies every motion by the defense.

Excuse me while gather my stuff and go home. This defies reality.

It's as if they decided to forget the legal arguments and go with the reality TV, talk radio talking points approach that's been so successful for DJT.

Apparently not a good strategy with Sullivan.

Tired of this. First, the plea agreement was for only one count for a set of false statements to the FBI?

Why in the hell is the DOJ spending millions of dollars and thousands of man-hours for a simple plea? If Barr can’t step in on such a ludicrous trail and expenses, what can he do? Just dismiss the damn case and save the government time and money. Go after real criminals. It’s sickening, the waste. For what? To put a respected General in jail for a few days.

Next, for those who said that the Judge walked back calling a decorated General a traitor for absolutely no reason. Bull crap. What was the judge thinking in the first place? There was and is no excuse, he must really hate Trump (who he was calling a traitor by extension) to come up with that thought process. There is absolutely no reason for those words to leave his mouth with his malice intent. Saying sorry doesn’t cut it. Remember this happened in the midst of the phony Russian bullcrap targeting Trump.

Would that not still be an option after Powell had an answer about getting the documents she requested and had a chance to review them? If not, Flynn had already kept up his part of the plea bargain by cooperating with the Feds, so I thought it would hold up even if Powell was never granted what she and Flynn sought, which was to have the whole shooting match dismissed.

There is so much wrong with that list.

Just to take one thing: Sullivan addresses the potential (not actual or “massive”) conflict of interest and applies the law to find that the situation was properly addressed.

Surely Powell knew this. Yet she proceeded as if she did not. Think about WHY.

I can’t think of a reason you apologize to Page. He was a CIA operative, sent to the Trump campaign to give the FBI a pretext to monitor the entire campaign with the 2 hop rule.
Remember, Hillary was supposed to win. Nobody was ever going to hear the name Page or know of the FISA spying.
Admiral Mike Rogers of NSA marched into Trump’s office and spoiled the plan.

Nobody in their right mind believes the FBI didn’t know page was a CIA operative, or that the sea I didn’t deliberately select him to play that role. He was perfect for it, he had Russian contacts he had London contacts, and he dutifully reported every time he had Russian dressing on a salad to the Trump campaign. He was there to set up Trump, and give the FBI access.

When the scam blew up, now he plays the victim.

Fully how Page was the -only- Trump guy Meuller didn’t charge with something from back in 3rd grade. That stinks to high heaven

Powell stated on several occasions she was NOT seeking to have the plea withdrawn.

Her entire position did not make legal sense. People supported her because they agreed with the political argument she was making. But as the judge found (entirely predictably) the political argument was irrelevant to the Brady claims.

I cannot decide what drove Powell, but either she is a very bad lawyer or she was motivated by some non-legal considerations.

I wonder how her book sales, go-fund-me and TV appearances are going?

Given the new evidence that the FISA against Flynn was not legal. Shouldn’t the appeal be based on throwing the case out over improper warrants issued?

Lost in all this “fog of war,” Flynn has a court order allowing him to travel to Korea from December 21, 2019 until January 7, 2020. Now that is really a head scratcher.

Powell had to work with what had already occurred and didn't want to throw the baby out with the bath water.

Sullivan did agree to postpone his ruling until after the Horowitz report, so must have lent some credence to what would come out.

I believe the go-fund-me account was srtrted long before she came onto the scene. Apparently the previous lawyers charged full price, performance notwithstanding. She was under no obligation to work pro bono. And I am glad someone had the balls to appear on the airwaves and speak for Flynn; Lord knows there was no shortage of appearances by his detractors, lol.

Book sales? Well, if that's a taint, then so many are the tainted.
