The Supreme Court just handed down what to me is one of the most dangerous rulings against not only the gun industry but the 2nd Amendment.
Your first thought should be, how in the world is Remington responsible for what some evil guy did with their rifle? However, this is not about actually winning the case; its about opening the door so that other people can bring the same types of cases financially crippling the gun industry.
The law hes referring to is the Protection of Lawful Commerce in Arms Act.
It a US law that says, you cant hold gun companies liable when one of their guns are used in a crime.
Before this law people were suing gun companies and winning on the grounds that they should have foreseen that their product would have been used by criminals.
This would literally mean gun manufactures would have to stop making guns and gun dealers would have to stop selling guns to the public. Gun companies can still be sued for defective products, breach of contract, criminal misconduct and any other actions where they are directly responsible just like every other U.S.-Based Manufacturer or consumer products.
Before the Protection of Lawful Commerce in Arms Act the argument was, you should know the guns will be used in crimes. Now after the act, they changed their argument to, youre enticing young men with your toxic masculinity weapons of war ads. Keep in mind everything he said is true not only of the AR15 but handguns as well.
Handguns are semi-automatic and they can hold the same amount of ammo as an AR15.
The supreme court allowing this case to go forward is monumentally bad for the 2nd Amendment. This is a money game. These types of lawsuits are not altruist; they are strategies. Theyre not just attacking the 2nd Amendment politically, they are attacking from all sides.
Theyre attacking it culturally, legally, financially, and with other angles, because they have the money do it. Bloomberg just spent million to turn Virginia blue.
He has his own media company and billions to spend on influencing other media outlets with his hate for the 2nd Amendment.
We cant outspend people like this. The only way to win this fight is to shift the culture and the only way to do that is with messaging. Which is why we have to inform and spread our message as wide and far as possible.
Thats why Im always telling you to share not only my videos but other peoples videos. It's the only way because trust me, this is monumentally bad for the not only the Gun industry but also the 2nd Amendment.
No its not a ruling. There will be a court case which can then be appealed to the SCOTUS for a ruling.

All too often many FReepers get emotionally carried away by a headline or an opinion lacking in facts.
Should we be surprised? They’ve already done this against opioid producers, even when it’s the illicit drugs that are responsible for most of the OD deaths.
This is a very dangerous precedent indeed.
How about lawsuits against Hollywood (actors, actresses,producers, theaters, directors, and studios)for promoting violence and other dangerous behavior?
It was not a ruling. It sent the case back to the lower courts to be decided. It leaves open the right of Remington to bring any decision that result to the SC.
The decision had to do with the right to bring suits, however frivolous, The suit itself does not abridge the 2nd unless the decision is in violation.
I would guess that if Remington is found liable, then the SC can rule on the constitutionality.
They didnt hand it down. They just didnt take it. They do what? 50 cases a year. Thats why trump filling those appellate courts are so important. People think the Supreme Court is most important. Nope! They have a very small caseload and when its full. Thats it.

My understanding is that the court allowed the lawsuit to proceed because it doesn't have the authority to intervene until AFTER a ruling comes out of the case in question.

The Connecticut Supreme Court said it would be a “Herculean task” for the plaintiffs to win this case against Remington.
Also, one of the issues those bringing the lawsuit are claiming is this....they are claiming the firearm’s makers....in this case Remington....are marketing these weapons to young people.
But crazy Adam Lanza did not purchase this weapon; he killed his mother and stole her firearm which was legally purchased.
The gun grabbers are also claiming that these are weapons of war. They are semi-automatic versions of those weapons, and were/are intended for sale to the civilian market.
Why aren't they held accountable?

Remington’s lawyers surely knew how the system works but this was such a slam dunk in their favor they gave it a shot. Naive I guess to have faith in those robed fools.
Also, are breweries, wineries, and distilleries responsible for accidents caused by drunk drivers?
What about the sellers of legal marijuana, in Colorado and other states where recreational pot is legal?
I do think he's right that the purpose of this suit is not to win, but to open the door for others.
