New York AG’s office totally disgraced itself in the Exxon trial

It seems the prosecutors feared it would just be too humiliating to admit they had nothing, and hoped they’d somehow stumble on . . . something.

Still, Thursday’s final retreat, dropping most charges at the very end, was a shocker. It left the judge dismissing those charges “with prejudice,” so the state can never refile them. And Exxon’s infuriated lawyers say those claims “have cost in many respects the most severe reputation harm to the company and to the executives,” so they want still stronger sanctions.

Judge Ostrager has 30 days to issue a decision. The prosecutors are surely praying he’ll find the Martin Act gives them so much leeway that he actually has to find Exxon guilty. If so, it’ll be a blaring alarm to businesses to have nothing to do with New York, because they have no hope of a fair break here.

Otherwise, the judge should explore every possible option for censuring the state’s attorneys — whose abuse of power here has been utterly mind-blowing.

The ONLY people who can fight these deranged and out of control prosecutors is a company with mega deep pockets or a very wealthy individual. Most of the rest of the world cannot which leads to “settlements” which are the equal of paying off Guido due to the threats by a Vito and Rocco styled justice system. Until individuals bringing these insane lawsuits have some skin the in the game like losing their livelihood by disbarment or even court imposed contempt fines which are punitive in amount, it will go on.

The state prosecutors should be arrested on Federal Civil Rights charges-- these are clearly politically motivated attempts at extortion and should be treated as such.

Maybe a set of RICO prosecutions against the state governments of New York and California.

A bunch of scumbag lawyers perpetrate a Fraud Upon the Court and the Public, as well as Exxon/Mobil, in an effort to Prove Exxon/Mobil committed fraud??

I agree they should be arrested. These clown prosecutors not only wasted Exxon’s money since they had to defend themselves, they’ve also wasted taxpayer money.
The N.Y. justice system is a joke. I’m surprised there are still companies that do business there.

As a New Yorker, who pays way too much in taxes, am clearly offended by this blatant disregard of the public funds they squandered with this nonsense.

By the way, can someone explain what actually happens to the “Judgements” levied on these companies when the swamp is successful at their extortion by judge?

The lawyers get paid their cut then donate those funds to the dimrat politicians who “went after” those industries. The rest of the money goes into the black hole.

The tobacco lawsuits are a good example of that.

Seems the judge should consider a loser pays judgement in the case of a frivolous lawsuit nd let the state of New York reimburse Exxon for attorney’s fees and court costs. A message needs to be sent to state AGs who have politicized the law by overreaching their jurisdiction.If the judge does not adjudicate it as frivolous Exxon might want to sue the AG for malicious prosecution and seek a damage judgement

Can someone please help me understand how or why the judge has any decision to make at all if the charges have been dropped?
