A federal judge ruled Friday that President Donald Trump violated federal law when he used his declaration of a national emergency to get millions for building a wall on the southern border, NBC News reports.
The ruling is a victory for El Paso County, Texas, and the Border Network for Human Rights, which sued to stop border construction in their community. They argued that Trump had no legal authority to spend more than what Congress appropriated for the wall project.
In January the president asked for $5.7 billion to build "a steel barrier for the Southwest border," but Congress approved only $1.375 billion. In February, Trump declared a national emergency and ordered that money for Pentagon construction projects would be used instead for the wall.
Federal District Court Judge David Briones said the president's order violated a provision of the budget law approved by Congress which said "none of the funds made available in this or any other appropriation may be used to increase" the funding for the wall project.

The funds had been previously appropriated to the DOD, and not yet spent, when Trump had the DOD divert those funds to the border wall. They were not DOD funds covered by the appropriations bill that restricted the use of THOSE funds from being spent on the border wall. - If my memory serves me correct.
Or maybe just line them up at the wall.
Every time I read this kind of crap, I hope that these asshole judges and politicians get a visit from an MS13 gang.

the judge is wrong. Presidents for years have used their discretion, signing statements, and authority to choose where to prioritize law enforcement.
if others have done it, this one can do it.

I think you are wrong. This judge has no authority to determing what is and what isn’t a national emergency — that is the sole responsibility of the President. Second, the Congress established the rules/law regarding the President’s authority to do things under a national emergency and Trump followed those to a T. Those proceedured included the ability of the Congress to vote on what the president was doing, including moving money from one pot to another and to try to override any veto the President had. They have used that proceedure twice and were vetoed. These a-holes in congress pass laws and then when they are used against them, they cry like little babies and seek their biased democrat judges to help them out.
