As of Friday, September 6, an extension of three months to prevent the U.K. leaving the E.U. without a deal passed the Houses of Commons and Lords. In order for that legislation to become law, there must be consent by the monarch in this case, Queen Elizabeth II. Once she assents, the bill becomes law.
While most everyone is considering her assent a formality on Monday, it should not quite yet be considered a fait accompli. The queen can lawfully refuse assent or delay her approval, which would effectively veto the bill and keep it from becoming law, thereby paving the way to a No Deal Brexit on October 31.
There are two occasions when the monarch can and should, according to most academic experts in the matter, refuse assent.
According to Anne Twomey, professor of constitutional law at the the University of Sydney in her book The Veiled Sceptre, the first occasion is that where a "serious error is discovered in the bill." No one is arguing that there is an error in the Remainers' meticulously crafted bill of extension.
But the second occasion in relation to royal assent, "the predominant academic view ... is that the Sovereign ... must act upon the advice of responsible ministers."
Professor of public law at the University of Glasgow School of Law Adam Tomkins concurs. From his book Public Law: "If the monarch were given clear and firm Prime Ministerial advice that she should withhold her royal assent to a Bill which had passed through the Houses of Parliament, it seems to be the case that the monarch should follow that advice."

It would be super ballsy, but I agree, if it comes to her assent...SHE WILL NOT GIVE IT.
Queen Liz likes Boris, Trump and her country’s sovereignty.
The Queen is just a figure head for this type of stuff. She has to sign the bill. And, I would not call 51.9 percent an overwhelming majority. If anything, it is a split.
I say she won’t sign it.
“Shes old-school, and must be gobsmacked to see what her following generation has come to.”
The Beatles (at el) screwed everything up.
This article makes a number of mistakes
1. An “extension “ hasn’t been passed. What has been passed is a request to request an extension. But there is no information on what the UK will do with the requested three months. Will it waste it shooting its foot like it did with the current extension?
2. The law then needs to be taken by the PM to the Queen for assent.
3. The Queen will always assent to a request by any PM
This is a request to request an extension.
There is no guarantee it will be taken to the other 27 and no guarantee it will be granted.
It’s begging for extension 3 and giving no indication what the UK will do with that extra time
The Queen will do no such thing. She assents to every request made by every PM
This is no chess game. Boris have shown zero ability to strategize over his careers as journalist and politician.
It’s political kerfuffle that’s all
Correct. The Irish border is the unsolvable issue.
The border must be kept open as per the good Friday agreement that the UK signed and swore to in 1997.
Yet the Republic remains in the EU and most northern Irish want to stay in the EU.
The simplest would be a one country two systems approach where northern Ireland was part of the customs union while remaining part of the UK
The UK got all it wanted in the deal except for the Irish border solution as Theresa May’s government was in bed with the DUP and couldn’t agree to the above solution.
What else wasn’t fair in your opinion, Brian Griffin?
You mean the EU bureaucrats and the ministers of the EU parliament, who may or may not actually have any say over aid bureaucrats? And why would any such petty tyrant choose not to exercise the full lawful powers of his office?
Don’t say I didn’t warn you what is going to happen.
This is what I’ve been saying all along.
The Yurp 5th columnists in Parliament want Boris to be in office but not in power. They want to tie his hands yet not allow him to take his case to the people....because they are acting to thwart the will of the people and Boris would crush them in an election and they know it.
Brilliant strategy and all but they seem to have forgotten that the PM can advise the Queen to withhold Royal Assent which effectively vetoes any bill by Parliament. Boris can even point out that Parliament has confidence in him as evidenced by their refusal to hold a vote of no confidence.
Whether Boris runs out the clock or whether so much as a single EU member state refuses to grant another extension, a clean break Brexit is coming.
The crying and wailing of the ReMoaners will be most delicious.
The Queen would not be giving up her political neutrality by withholding assent if that is the advice of the PM. The Queen always follows the advice of the PM in granting or withholding Royal Assent. Tony Blair did it 3 times. If Parliament does not like that, it can hold a vote of no confidence in the government. It would be a political act if the Queen went against the advice of the PM, not vice versa.
Neither the EU members nor the UK Remainers want a negotiated soft Brexit, they want Brexit to totally die, they have no desire to follow the express wishes of the people, therefore they are doing everything to sabotage negotiations.
Note to Americans: give up your sovereignty and you will never get it back.
The rest of the EU now want the UK to go.
Any updated predictions about this? Seems Queen has assented after all
Yes, the queen approved, it’s law,
It even gives incite on the abdication of the throne by her Uncle, which set up the events for her to become Queen.
That's the "Irish Backstop." The problem is that the Northern Ireland Unionists that make up part of the Tory coalition reject anything that separates them from Britain and makes them closer to Ireland. The truth is that Britain would love to offload Northern Ireland, a big expense in general, in its entirety and give it to Ireland, but the Irish don't want to deal with the Loyalist violence that would result and the Brits don't want to deal with the political backlash and flood of Ulster protestants fleeing to Britain that would result.
