Thats my question. Does she take the Fifth? Think of it, OBrien said. Youre Kim Foxx now, and youre thinking, Ive got to hire a lawyer. The county cant pay for that, I dont think. Hope not. Youre her lawyer now. What do you do? She has that right. Do you have her take the Fifth?
But could a Cook County prosecutor seeking reelection find refuge in the constitutional protection against self-incrimination? To perhaps shield those above her in the political food chain who sought protection for Smollett, the former Empire TV show star with many celebrity friends?
What should be of key interest are those phone calls, texts and emails Foxx had with outsiders who sought mercy for Smollett.
Among them is prominent lawyer Tina Tchen, the former chief of staff of former first lady Michelle Obama.
Im told that those who know Tchen say shes cautious, and that it is unthinkable she would reach out to Foxx on her own.
Foxx, a protege of Cook County Board President Toni Preckwinkle, had been angling to one day replace Illinois Democratic U.S. Sen. Dick Durbin. Foxx has cozied up to Hollywood stars and to Democratic presidential candidate Sen. Kamala Harris of California.
Smollett isnt all that important. I dont care whether he goes to jail. Hes a show pony, a pimple in this drama. The critical thing is what is left of the integrity of the justice system in corrupt Cook County.
What is important is finding who Foxx talked to, and why, and why she said shed recused herself from the case, even though she had not.

Sadly, as we all know, nothing will come of this.
We are at the point where certain portions of government (no, make that virtually all of government) will have to be totally ignored in lieu of smaller local concerns doing the leadership.
And, of course, big gov will try force.
And we will have to respond. Respond or bend over and assume the Obama position of total stupid “do it to me”.
Right, Foxx said she will cooperate fully with the SP which tells you the SP is a Rat.
Either that or she’ll suddenly develop a really bad memory and got the Hillary “I don’t recall” route.

She has nothing to worry about. As we saw with Marilyn Mosby, if you are the correct color and belong to the correct party, you can get away with anything as states attorney.
Hard to say IMO...she’s with Toni Preckwinkle’s faction. Preckwinkle lost to Lori Lightfoot in the mayoral race, there’s no love lost between ‘em, and Toni’s showing signs of not bowing out gracefully or going away quietly.
There may be some collateral damage apart from the investigation: Foxx is up for reelection in 2020. She has drawn a primary challenger and will also likely have to face a Republican opponent in the November general election if she is renominated during the March primary. Although it is an uphill battle, Republican candidates occasionally win the prosecutor’s office, provided that the Democratic incumbents are tainted by scandal and controversy. Many members of the Chicago Police Department despise Foxx for her restorative justice policies and her refusal to charge criminals for felonies.
Foxx’s lefty sponsors on the Democratic Central Committee endorsed her with a voice vote as opposed to an actual roll call vote. There is talk that competing wings of the Democratic Party are not in complete agreement about Foxx. It is the Daley faction versus the Obama camp.
