DENVER A U.S. appeals court in Denver said Electoral College members can vote for the presidential candidate of their choice and arent bound by the popular vote in their states. The 10th U.S. Circuit Court of Appeals ruled Tuesday that the Colorado secretary of state violated the Constitution in 2016 when he removed an elector and nullified his vote when the elector refused to cast his ballot for Democrat Hillary Clinton, who won the popular vote. It was not immediately clear what effect the ruling might have on the Electoral College system, which is established in the Constitution. Voters in each state choose members of the Electoral College, called electors, who are pledged to a presidential candidate. The electors then choose the president. Most states require electors to vote for the candidate who won the popular vote in that state, but the Denver appeals court said the states do not have that authority. The Constitution allows electors to cast their votes at their own discretion, the ruling said, and the state does not possess countervailing authority to remove an elector and to cancel his vote in response to the exercise of that Constitutional right.

Yes - there is! Its the whole point of the winner take all electoral system.
The presidency is ultimately decided by the states. Its not a direct democracy.
Your vote determines how the state votes and the state sends its political representatives (usually nominated by the winners) to cast the votes but those representatives can still choose to vote their conscience. They almost always wont because theyre first and foremost political operatives.
This is a GOOD ruling and smashes the Dems attempt to enact a direct democracy by fiat.
More Americans would pay closer attention to the Electoral College if they had a good football team.
I see what you’re saying, and I hope it works that way in practice.
I really do.
Political betrayal is not going to go over well.
[[[This invalidates all the state laws that say their votes go to the popular vote winner]]]
Which popular vote, state or national?
The assault on America continues.
If DC ever gets a team that should be their name.
I think that will be the Fort Sumter of CW2. When a liberal state turns over their voters rights to vote Trump or whoever and turns an election.
That is surely when it will happen. Whether it happens by their own citizens or invaders from neighboring states to find the traitors. So be it.
National vote and proportional vote.
Again - the electors are political operatives nominated by the winning party of the state theyre not, in general, going to go against the political wil of the state.
Even in this court case it wasnt a Trump elector being sued but a Hillary elector who didnt cast a ballot for Hillary (who had already lost!)
That’s why parties choose electors who would commit political suicide if they went against the nominee.
A U.S. appeals court in Denver said Electoral College members can vote for the presidential candidate of their choice and arent bound by the popular vote IN THEIR STATES.
It does - Trump still win the presidency even with these shenanigans (and as I point out elsewhere this case involved a Hillary elector who didnt vote for Hillary who had already lost - not a Trump supporter.)
Thats why theres such a push for the popular vote under the guise of direct democracy and your vote is being stolen
No - its being stolen by those whove flooded our nation with illegal immigrants, lauded them with social services and gifts and then given them voting rights to maintain political power. With direct democracy - Californias illegal immigrant boondoggle wouldve given the nation to Hillary.
So basically, what the “court” said is, voting in Colorado is nothing more than statewide masturbation.
This will also end forcing electors to vote by national popular vote.
They NEVER were!
And yet they almost always have - because electors are picked by the winning political party!
No - the votes go to the candidate and the winning candidates party in the state chooses the electors.
Judges appointed by....?
I think the decision is correct. The Framers had a utopian vision of the Electors as a functioning body that would carefully select a President from a number of candidates. In any event, Elector is an office under the Constitution and the Elector casts the vote.
Our new Democrat Secretary of State, a tool with an IQ of a warm Spring day, denounced the decision because the Elector in question was a Clinton Elector who did not vote for her. But, my FRiends, consider this: Colorado has joined the Interstate Compact to effectively abolish the Electoral College by requiring Colorado's Electors to vote for the national popular vote winner. This decision also renders that legislation unconstitutional.
