Vanity: Citizenship Can Be Revoked For Those Lying in Application
VANITY

Posted on 07/16/2019 9:14:59 PM PDT by TigerClaws

If it can be proven Illhan Omar lied applying for citizenship, she can be deported back to Somalia. Her project in improving her home country can then begin.

For those unfamiliar with the facts, she allegedly used a sham marriage to a man who was, in fact, her brother to become a citizen here.

Law sources:

Consequences of Providing False Testimony During Naturalization Interview

If you knowingly and intentionally provide false information (orally) during the naturalization interview and testing process--or if USCIS discovers that you falsely testified in order to gain immigration benefits in the past--you can expect your citizenship application to be denied. Or, if the lie is discovered later, USCIS can revoke (take away) a person's citizenship. The naturalization interview is held "under oath," meaning that right from the start, you raise your right hand and swear to tell the truth. The immigration laws specifically say that, "No person shall be regarded as, or found to be, a person of good moral character who, during the period for which good moral character is required to be established [has] given false testimony for the purpose of obtaining any [immigration benefits]." (See the Immigration and Nationality Act (I.N.A.) Section 101(f)(6).) As you probably know, receiving U.S. citizenship via the process of naturalization requires proving good moral character. Depending on what a person lied about and the implications for their immigration status, there could also be further consequences, including being placed in removal proceedings and ultimately deported from the United States. For example, if a man was to lie during the naturalization interview and say that he was still married to the woman who helped get him a green card--and the fact that he was actually divorced was not only discovered, but led to a finding that the entire marriage had been a fraud--removal would be the likely consequence.

Would anyone have the balls to do this? And would the courts allow it? I would sure hope so!

Women don’t have to register for the draft.

This would allow her brother to be deported but not Omar—since it was his application and not her application.

Didn’t she become a citizen when still a child. Marrying her brother to get him into the country could get her in some serious trouble,

Good post. I would expect the President of the United States also knows this and take the appropriate action.

Keep in mind...falsifying official documents is the preferred criminal method to cover-up larger crimes.

===========================

REFERENCE--Falsifying Government Documents. involves altering, changing, or modifying a document for the purpose of deception.......can also involve forgery and/or passing copies of false documents. Falsifying documents is usually done in connection with broader criminal aims, such as extortion, government fraud, tax evasion, money laundering, financing terrorism........

Types of documents commonly falsified may include:
◾Tax returns and income statements
◾Personal checks
◾Bank account records
◾Business record keeping books
◾Immigration documents (such as visas, passports, etc.)
◾Identification cards and birth certificates

Many different types of acts can be considered as falsifying a document, including:
◾Altering or misrepresenting factual information such as prices or monetary amounts
◾Stating false information when requested to provide truthful statements
◾Forging a signature
◾Using official letterheads without authorization
◾Concealing assets or property WRT obtaining federal/state grants))
◾Knowingly using or distributing a fake document

A person can only be held criminally liable if they are deliberately acting with the intention of deceiving or defrauding another party.

Falsifying documents is a very serious offense and is generally classified as a felony. This means that a person charged with falsifying documents may be subject to the following legal penalties:
◾Having to pay a monetary fine
◾Incarceration in a prison facility

Depending on the gravity of the offense, as well as individual state laws, falsifying documents can result in a prison sentence of 5-10 years. Also, if government documents or authorities were involved, the legal penalties may be more severe. ..... legal penalties may increase with repeat offenses.

The penalty for falsifying government documents is outlined in the Crimes Act of 1958.

I don't when she did this, but the statute of limitations has likely long ago run out on any criminal charges to be pressed against her.

As for him, he could be deported. Just like we deported Nazis who lied on their applications 50 years earlier.

Which isn't the same as saying that we have a Justice Dep't willing to take on this 'propaganda potato' the year before an election.

None of us have seen the evidence wither. I suspect this would be more difficult to prove in court than it was to prove that a Nazi was a Nazi (given the German proclivity for keeping meticulous records ...)

It is felony fraud for her to claim her brother as her husband for the purpose of his immigration.

Not according to the Supreme Court.

Maslenjak v. United States (2017)

AllLaw.com should probably update their web page.
