It’s not a Pocket Veto until it passes both chambers of Congress and is forwarded to POTUS.
Once that’s done he can sign, veto or just sit and do nothing. The do nothing option is a pocket veto.
“Is this a pocket veto?”
President Trump must sign a bill to make it law. He will not sign the Senate continuing resolution bill into February.
The House could pass it but he won’t so, no law and no, veto not necessary at this point. The House is likely going to sit around on their thumbs for a spell doing nothing.
Let the drama live!
Looks like it to me. A pocket veto is one where the signing of the bill into law is postponed until it’s too late to be dealt with in the current legislative session. It’s held “in the pocket” as it were.
For a pocket veto, there must be a bill on the Presidents desk. Then rather than signing it, he folds it up and puts in his pocket and acts as if nothing happened.
A “pocket veto” is when the Pres simply ignores the bill. It sits in his in-basket until the time period for signature runs out, or the legislative session closes, killing the bill.
Pocket veto is when a POTUS does not sign a bill and then the Congress is in adjournment, so can’t override a real veto................
Yes, in effect. It sits there on the President's desk, in limbo since it is neither approved nor vetoed.
I think that if it were re-voted with a veto-proof majority (which won't happen) that it would become law immediately, though.
What is called a pocket veto is found in Article 1, Section 7 of the Constitution. Essentially the President is required to sign or veto within 10 days (excluding Sundays). If he/she does not, it becomes law. If it is vetoed, it is returned to the originating house, who decides if it will attempt an override. Both houses must vote by 2/3 to OR. If the Congress is in adjournment, the bill dies without signature (said to be the pocket veto). In the present case, no bill has been presented yet. If it is tomorrow, then PDJT could hold it without taking action. He would be able to hold it until January 2 because 12/23 and 12/30 are Sundays. Since the terms of both houses end on December 31, the item would be pocket vetoed as both houses would be in adjournment. I hope this helps. Note that PDJT said he would not sign it; he didnt say he would veto it. Im thinking a pocket veto is in order.
