Is Special Counsel Mueller’s Office About to Have Its First Conviction Overturned?

Last week, both special counsel Robert Mueller’s office and former national security adviser Lt. Gen. Michael Flynn’s defense team submitted dueling memorandums to U.S. District Judge Emmet Sullivan, who is preparing to sentence Flynn on Dec. 18.

Flynn’s filing brought up the subject of FD-302 forms, which are the official records that FBI agents file following interviews with subjects of interest. In its memo, the defense noted that a 302 form provided by Mueller’s office was dated Aug. 22, 2017, more than six months after the FBI’s interview with Flynn actually took place.

Since FBI rules and regulations state that 302s must be filled out within five days of the interview, the fact that the Flynn memorandum referenced a 302 form filled out and filed more than six months later garnered immediate attention in the news media.

A curious feature of this months-late 302 form was noted by my colleague, Jeff Carlson, in his recent column in The Epoch Times, titled “New FBI 302 Document Appears to Reveal Interview With Agents–Not Flynn.”

This particular 302 form, which is cited five times on Page 14 of the Flynn memorandum, is an interview with former FBI Deputy Assistant Director Peter Strzok, who was subsequently fired from the agency after an extensive investigation by Department of Justice (DOJ) Inspector General Michael Horowitz.

It seems odd that a case would get this far, with the FBI agents essentially pulling hearsay info out of their fannies.

Odder still, these same agents will finish this case one way or another and simply move on to destroy the next man.

Some judge could come along and pull this nation back from the edge of a coup.

The guy might be seen as a hero for hundreds of years to come.

What happened to the indicted Russian company charged by Mueller and demanded a speedy trial. Where does that stand? The Flynn sentencing has taken a year. Why?

I think Comey made a big mistake the other day....bragging about getting away with sending in two “moles” to talk to Flynn....with the intention to trap him with anything he said.

This is that sort of Judge. He presided over the Senator Stevens (Alaska) trial and after the conviction that cost Stevens his seat in that next election, the Judge found out what the DOJ had done in its false conduct and threw out the conviction.

That one vote would have stopped Obama Care.

The DOJ prosecutors were sanctioned and penalized by this very judge. Sydney Powell writes about it in her very good book Licensed to Lie.

Mueller’s history is nothing more than fraud and scams.... HE’S THE ONE WHO OUGHT TO BE CHARGED WITH FELONIES!!!

Yup.

Was majorly sickened reading Clarice Feldmans piece at American Thinker today about the Prosecutors who lied , suborned perjury and withheld evidence to convict Ted Stevens.

Basically, all they got was a letter in their file and back to work they went.

So who in the FBI or DOJ would worry about getting caught doing the same to Trump associates when they know nothing will happen to them?

Thank you for the mention.

We can hope he’s open to that here.

It’s a disappointment to me that the FISA Court Judge (or panel) didn’t summon Mueller back in front of them when they found out the documents he used for warrant justification were fraudulent.

So it’s not just the FBI and other bad agencies and players, we have a corrupted judicial branch as well.

Of course this extends the problems of the Ninth Circuit Court of Appeals and others, which we were already aware of.

They then appealed the decision and ended up with only a letter of reprimand in their files.

I spent a pleasant 15 minutes talking to Sidney Powell a couple of years ago.

I even bought an autographed copy of her book before it took off.

Got her card somewhere...

I’m watching the Sopranos right now and have nothing but contempt for the FBI guys. I don’t think we’re supposed to be on their side, but I have more respect for honest criminals than agents who are ordered by a judge to restrict themselves to the basement when bugging Tony’s house but look anywhere they please. Criminals with badges.

I’m not predicting the judge overturns it but I’m very convinced it would be justice. They’ve already ruined Flynn and it was a clear set up. Their response to the judge - not producing the actual 302 - is very suspicious. Wonder how the judge will react.

Thus far, it’s looking as if the special counsel has committed two serious infractions:

1. They did not turn over exculpatory evidence before Flynn pleaded guilty and only did so when Sullivan specifically ordered them to do it, and,

2. They have withheld Pientka’s original 302 form from Sullivan after he explicitly demanded access to it.

Either of these infractions would be serious enough to cause Sullivan to throw out this case.

Perhaps PDJT's slow and careful "hands off the Special Consul" policy has been to allow Mueller to commit unethical infractions and criminal destruction of evidence figuring he wouldn't get caught.

If the Mueller special counsel prosecutors are caught engaging in misconduct such as this, you can be sure every other person they convicted or even brought a case against is going to demand a retrial and a Brady ruling on their own behalf.

Also Mueller's entire case files would become evidence that could be used to prosecute him and all those in conspiracy with Mueller to violate Federal Law and Civil Rights, right back through the fraudulent Pee Pee dossier and those creating it.
