The Latest: Judge orders county to accept late ballots

ATLANTA The Latest on the race for governor in Georgia (all times local):

8:15 p.m.

A judge in Dougherty County has ordered the county to accept absentee ballots postmarked by Election Day and received by Friday.

The ruling was a result of a lawsuit filed by the Democratic Party of Georgia.

Abrams for Governor campaign chairwoman Allegra Lawrence-Hardy says the campaign will continue to take legal action as necessary until every eligible vote is counted.

The campaign filed a complaint in federal court asking for an injunction to direct the board of elections to count any absentee ballots received between 7 p.m. on Election Day and close of business Friday, which is consistent with the way that counting overseas military and overseas citizens' ballots is handled.

Unofficial returns from Tuesday's midterm election show Republican Brian Kemp with 50.3 percent of the vote. That's a lead that would make him the victor without a runoff.

A populous, majority-black county in metro Atlanta says its elections office will remain open past normal hours Friday to accommodate provisional voters who needed to provide identification so their votes can be counted.

DeKalb County has about 750,000 residents and could help Democrat Stacey Abrams close the gap on Republican Brian Kemp in Georgia's gubernatorial race.

But two groups supporting Abrams' call to count all votes, ProGeorgia and Care in Action, say at least 12 other counties certified election results before Friday. Such a move could leave provisional ballots uncounted.

The secretary of state's office did not immediately respond to an email seeking comment.

If the law does not allow this then the judge is lawless and should be removed from the bench and charged with corruption.

The democrats want all of the Get out the vote ballots counted because they are fake votes that were created by democrats.

All of this crap all over the nation would come to and end if Early voting was outlawed. It is a tool for vote fraud. Preserving the integrity of elections far out ways lazy convenience.

Again with the ‘count all votes’ mantra. And as usual, they want to count the provisional ballots in the now blue counties surrounding Atlanta.

I wonder how many provisional ballots there are in Republican counties - likely very few but I would like to know for comparison.

Obviously there aren’t any federal judges who are concerned about election laws or the disenfranchisement of Republican voters. It would seem to me that this gambit should work both ways. WTH!

Also this is a Federal election. All these rouge ruling need to be appealed to the USSC. Because of the circumstances then the USSC should have no choice but except the cases on an Emergency basis.

We got to make sure the military ballots, that were postmarked by Election Day are counted.

So sue me, but if they are postmarked by Election Day, they should be counted. It works that way for tax returns postmarked by April 15th, so why not absentee ballots?

Republican officials are idiots are always trying to meet the criminals halfway. They think they can give the guy robbing them half the money in their wallet.

The democratic party is operating as a seditious enterprise outside the rule of law. They are subverting every institution that makes government work. You can’t have a free and open society with such people, just as you can’t have a free and open society in prisons.

Unfortunately, raw power is the only thing that will keep them in check, just like any other criminal. Armed officers should be responsible for the security of ballots with observers from both parties. As soon as the chain of custody is lost, the ballots are discarded.

USA is practically in name only now. I see only two directions: a civil war where patriots fight like 1776 or most likely the continuation of the erosion and slow death of a Republic where the new normal is worse than what we saw in the past.

It’s probably about the Overseas Military Ballots that were postmarked on or before Election day.

Absentee ballot law in Georgia (as shown on the Georgia Secretary of State website):

A ballot must be received by the county registrar no later than the close of polls on Election Day.

The State of Georgia allows you to request an absentee ballot up to six months before Election Day. If you can't get it returned by Election Day, then tough sh!t.

Is there a link to Georgia Election Law to go along with this?

How about O.C.G.A. § 21-2-386 (a)(1)(F)?

All absentee ballots returned to the board or absentee ballot clerk after the closing of the polls on the day of the primary or election shall be safely kept unopened by the board or absentee ballot clerk and then transferred to the appropriate clerk for storage for the period of time required for the preservation of ballots used at the primary or election and shall then, without being opened, be destroyed in like manner as the used ballots of the primary or election. The board of registrars or absentee ballot clerk shall promptly notify the elector by first-class mail that the elector's ballot was returned too late to be counted and that the elector will not receive credit for voting in the primary or election. All such late absentee ballots shall be delivered to the appropriate clerk and stored as provided in Code Section 21-2-390.

Most likely Georgia statute has clear procedures for when the canvassing of provincial ballots is closed. Same goes for mail in ballots. The reason there are definite time periods is to prevent fraud and to keep elections from dragging on.
