If you are a LEGAL immigrant and you have a child yes it is an American, If you are ILLEGAL you and your child are illegal!

Not so fast! The quotation from one of the authors of the 14th Amendment states that children born to "aliens" would NOT be included. The term "alien" implies a LEGAL immigrant.

The notion that children born to an ILLEGAL alien would have this benefit would have been laughed out of court by anyone basing a decision on original intent.

As I understand it you would be correct, except that Congress passed a standing resolution abrogating their authority over immigration by transferring it to the president. Congress could take back this authority with another law, but haven’t.

After the Civil War some people argued that freed slaves were not citizens, because they didn’t enjoy citizenship as slaves. The first part of the 14th was written to grant citizenship to slaves. Unlike illegal aliens slaves were “subject to the jurisdiction” of the United States government.

Let’s assume the drafters of the 14th Amendment were not morons. They had a choice between:

1. “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside,”

and

2. “All persons born or naturalized in the United States are citizens of the United States and of the State wherein they reside.”

They chose and ratified the first version. The only logical interpretation is that the phrase “and subject to the jurisdiction thereof” was intended to have a restrictive meaning. The children of parents with foreign citizenship and no legal residency are constrained by our laws but are subject to the jurisdiction of their parents’ home government, not that of the United States. President Trump is completely right about the fiction of “birthright citizenship”.

Another thing he will prove is the benefit of the conservative balance on the Supreme Court, which is to his credit. When the Supreme Court uphold Trump’s executive order, his supporters will call for a national holiday with dancing in the streets! Oh! The people who argue that illegal aliens are “subject to the jurisdiction” of the United States government are trying to bypass the fact that aliens are subject to a different set of rights under our legal system than citizens. For instance, the government can’t deport me. I’m a citizen.

This defeats the jurisdiction excuse.

The 370,000 births per year to illegal aliens is false-flag misleading. Families of these children use them as anchor babies. They immigrate in droves and declare their rights to citizenship as families of citizens. It’s just like illegal immigration. They bypass all of the rules and quotas. We have no recourse for rejecting them until Trump signs that anchor babies are no longer citizens.

On the contrary, I endorsed him (and voted for him) and agree with most of his major policies, including enforcing our immigration laws.

Saying "dead wrong" implies that many others have not held that "birth-right" citizenship for aliens is plain wrong and a misreading of law, the Constitution, and the 14th amendment meant to protect former slaves and indigenous tribal americans against Democrats in the post Civil War south.

Also no one is talking about the cost you and I incur in terms of increased medical, educational, granting of Social Security benefits to people who have not had one cent taken out of their earnings.

We should not pay for non contributors, especially when we are giving money to countries they are coming from.

Heres’ an idea. Start recharging their real home country for the cost including reducing any moneys being sent by that amount.....

See how fast the home politicians like that one.

As usual Trump is right!
Just because previous administrations did not enforce the law doesn’t mean Trump shouldn’t as well. If they want birthright citizenship, then pass an amendment.

In reality neither does the US except as interpreted in the last 40 years or so. This interpretation has no basis in law. Trump is fishing for a SCOTUS ruling on this issue confident that it will rule against Birthright Citizenship for children of illegal aliens. Min. 5-4

They and their parents should have to go through the application process provided by law.

From their home country like anyone else. No jumping to the front of the line because a mother plopped out her foreign baby on USA soil.
