In terms of consent drinking is not an issue, however drinking may effect her memory of the event.
I also think the current standard of sexual assault is ridiculous. By today’s definition a teenage boy trying to get to second base (even over the clothes) during a makeout session is guilty of sexual assault if the girl objects. Sexual assault used to mean something serious, now it can be almost meaningless.

The Dems want to drag out any confirmation so as to pack the court for the above case. Obviously the lower court ruled that illegal alien criminals walk free, if Homeland Security fails to immediately take the criminal alien into custody. With Sanctuary States and cities fighting ICE, and refusing to hand over illegal aliens, this becomes very important.
Would Kavanaugh be able to be part of the ruling, if he were not seated by the time the appeal is heard by the Supreme Court?
If the vote is split (probably will be), the ruling of the lower court would stand and the Dems fighting ICE and Trump will have succeeded in allowing illegal alien criminals to be immune to arrest or prosecution for their illegal entry into the US.

She may - I wouldn’t be surprised to see herdo a bit of a closing statement. I’m not as critical of her as some because I don’t think she has been trained for bare knuckle politics.
