WaPo: Brett Kavanaugh could drastically shift the court to the right. The Senate should take care.

Judge Brett Kavanaugh’s nomination to replace retiring Justice Anthony M. Kennedy on the Supreme Court comes at a tense moment. It could drastically shift the court’s tenuous ideological balance, and it comes not long after Senate Republicans disgracefully blocked President Barack Obama from making a court pick in his final year. More than ever, the court is in danger of becoming viewed as an instrument of politics rather than an independent, nonpartisan branch of government.

That is why senators must be even more exacting than usual when they evaluate Mr. Kavanaugh. They should insist on a justice who would rule with modesty and genuine independence of mind — and a willingness to resist abuses of power by this and future presidents. “I believe that an independent judiciary is the crown jewel of our constitutional republic,” Mr. Kavanaugh said following his introduction. He must show he means it.

Mr. Kavanaugh meets the basic qualifications for high court service. A Yale Law School graduate who clerked for Mr. Kennedy, he has served for 12 years on the powerful U.S. Court of Appeals for the District of Columbia Circuit. The country certainly could have expected worse from President Trump. Yet Mr. Kavanaugh came from a list of potential nominees preapproved by conservative activist groups. Their goal is to tilt the court as far right as possible as quickly as possible.

Mr. Trump’s first nominee, Neil M. Gorsuch, was, in his confirmation hearings, the least forthcoming Supreme Court nominee in recent memory. Mr. Kavanaugh must do better. Fortunately, he comes with a huge record.

you’d think they would so they could go on the attack instantly, but modern-day “journalists” are a bunch of lazy SOBs, so we probably won’t see much specific in the Kavanaugh attacks for a day or two, and then all the lesser leftist fake stream media outfits will just copy and paste from those who do the heavy lifting ...

true enough, but presumably in the next few days their attacks will evolve from generic to specific, at which point it’ll be much easier for us to see how good our guy is ...

The other day I posted this, and I stick by it:

It’s fun to watch the Left flapdoodle over the idea that this Justice pick will somehow enable more of what they assert are Trump abuses of power because if he really does pick the sort of people he says he will they would be active impediments to abuses of power by Trump.

And that includes the abuses of power the Left has come to depend on ... which is what they are really nattering about.

President Trump is not only NOT abusing power they way they think he should do but if he gets his way they’ll not be able to as well going forward either ... and that just will not do!

i am highly suspicious. i don’t think the rhetoric of the Washpost is not strong enough to indicate any real reservations about this pick. i hope i am wrong.

No, not really!

They'll NEVER stick to "facts" ( they don't know any ), but rather, go into their delusional, hysterical mode at a yet higher decibel, claiming that Kavanaugh will stop abortions, put those who have had them in cages, kill the ILLEGAL INVADERS, fire Mueller, and set up gas chambers for everyone who voted for Hilary and Bernie. And probably a whole of other insane things that I am far too SANE to ever come up with.

If the WaPo is upset over the politicization of the Court, they should have supported the nomination of Robert Bork and opposed Ted Kennedy's character assassination of him. Typical liberals. They create the monster, then cry like little girls when the monster turns on them.

not to worry. WaPo is just getting started. they haven’t done much research yet on kavanaugh’s decisions, nor have they sicked their rabid columnists on him yet. The next couple of days will be a different story. And then there’ll be NYT, LA Times and a gazillion others ...

WaPo is so full of crap with this “danger to democracy” argument. The Supreme Court is one of the main reasons why the people of this country voted for Donald Trump in an electoral college landslide.

It is not a conservative court that should ever be feared for all the conservative court does is uphold our 200+ year old constitution as intended. It’s the leftist court that must be feared for it creates law out of thin air. Trump has done an excellent job so far protecting us from that type of institutional terror.

Although Judge Kavanaugh decided correctly in court case Priests for Life v. U.S. Dep't of Health & Human Services, he wrote a moderate opinion disagreeing with the Priests on a foundational constitutional religious liberty principle. I<

As a result of Obamacare, the faith-based organization Priests for Life and others argued that the government could not compel or force them to provide contraception and abortion causing drugs for their employees. Judge Kavanaugh unnecessarily conceded in his opinion that the government has a compelling interest to force religious organizations to provide contraceptives and abortifacients for employees. Kavanaugh's concession created a dangerous precedent. I<

There are also concerns with his opinion related to illegal alien female minors who are expecting but also seeking an abortion in the United States. Other concerns relate to his writings on Obamacare. It’s been argued that Judge Kavanaugh provided the roadmap to uphold the Obama Administration’s healthcare overreach at the Supreme Court. Judge Kavanaugh is said to provide the legal argument for Chief Justice to save Obamacare by calling the mandatory insurance a tax. I<

If Trump is around till 2024, it’s possible that he’ll pick a total of three additional justices (for Thomas, Ginsburg, and Breyer). There’s even a remote possibility that Alito might retire (he’s 68 right now and in good health).
