Senate Majority Leader Mitch McConnell defended himself Thursday evening against claims that he is being hypocritical by pushing to confirm a new Supreme Court justice before the upcoming elections.
After Justice Anthony Kennedy announced his retirement, McConnell said on the Senate floor that legislators "will vote to confirm Justice Kennedy's successor this fall," which prompted an outcry from Democrats, who accused the majority leader of hypocrisy for not waiting until after the elections as he did when former President Barack Obama nominated Merrick Garland in 2016.
"Sen. McConnell set the new standard by giving the American people their say in the upcoming election before Court vacancies are filled," Democratic Minority Whip Dick Durbin said in a statement, according to CNN.
"With so much at stake for the people of our country, the U.S. Senate must be consistent and consider the President's nominee once the new Congress is seated in January."
"What I said in 2016 is that we shouldn't fill a Supreme Court vacancy in the middle of a presidential election year. The last time I looked, there's no presidential election this year," McConnell said on Fox News Thursday.
"And, in fact, three current members of the U.S. Supreme Court were completed in election years, non-presidential election years. And the president's nominee to the Kennedy vacancy will be confirmed in a non-presidential election election year," he added.

Bill Maher doesn’t have a law degree, as far as I know. (Does he have a high school diploma?). Sheila Jackson Lee would have been a more likely choice for Hillary—law school graduate, Yalie, female, black. Much better than a white male.
The democrats will pack the court to the best of their ability no matter what we do.
There is no point to us “holding back,” we need to put a solid justice on there, and as many as we can. Before the “pendulum” swings again, God forbid.

“But wanted a Constitutionalist.
LOL Ah ok, whatever he says. Is this guy running for office again? Why does he sound defeated and meek like a little dog?
Exactly.. Democrats.. the Party of Perpetual Outrage.
Die hated by the left, if Ruth were to retire?
After all she’s done for leftist causes on the bench? Remember, she was informally the “ACLU” representative on the court, as her legal history includes time as the general counsel for the ACLU. Point being, she’s as liberal as they come, and has ruled for key liberal causes during her time on the court.
Yet, she could end up being hated if she left. How strange.
We have seen that with some leftist reaction to Kennedy leaving. Kennedy too has give the leftists some key rulings which they should be happy about. But instead, to them, he is dead to them, because he has the audacity to retire now.
Democrats new rule, you can only pick a Justice for the SCOTUS in odd numbered Years because that was what Biden really meant to say.
>> If one of these two kick the bucket, the Libs will not have any Court power for 30 years <<
It ain’t necessarily so. Dhimmi theoreticians are already making plans to “pack” the Court — as done by Lincoln and as tried by FDR — once the Left is back in power.
LOL..Weekend At Buzzies.
If they could have in 2016 they would have pushed Obama’s choice through but the Pubs had the majority. Now they want the same power as a minority that the Pubs had as a majority. Sorry, elections have consequences.
So where is it written that a Supreme Court vacancy can only be filled in odd numbered years?
Yep, you are right. That was the Scalia seat which needed to be filled by Trump. Had they let Trump have his way then, they would get good public support for a moderate now. Instead they have nothing.
None of this matters. We 9the people say there will be a new Justice this fall. Do it it look for other work!
Yeah really. It's kinda nice having him on our side when he starts swinging his nads around. He needs to do it more often.
If nothing else, the left is in essence getting McConnell to go on record saying he won’t push a nominee through if one opens up in 2020. This is a huge mistake on his part because if that happens, we need Trump to fill the seat right away. He needs to walk this all back right away.
Because the left treats the Court as a left wing super legislature, they cannot be trusted with seats. They have disqualified themselves through years of activism and cannot be permitted to sit on the Court.
You summed it up expertly. Even some of the saner libs said basically the same thing then and were ignored.
Of course, Harry Reid started all of this off by going nuclear and now its come back to bite them.
Very true that Harry Reid is the guy who got us here.
The traditions of the Senate, etc. made doing away with the filibuster unthinkable, until Harry did it a few years ago, to confirm some lower court nominees.
So here we are. For short term gain, and a few liberal judges confirmed then, now Democrats are seeing the shoe on the other foot, as Republicans use the same tactic against them.
Was it worth it, a few liberal lower court judges, in exchange for conservatives not facing filibuster to the Supreme Court?
Anybody ask Chuck Schumer about what he thinks of the trade off?
Re Flake: see post #27. Seems to make sense.
That was a presidential election. The fools who wrote this want to hold off for an off year election. We control the senate for a reason, and it’s not to listen to libs.
