Unbelievable! A judge can force a failing business to stay open? WTF?!! America's judiciary is completely out of control and needs to be reigned in.

That is lawless and out of line. I hope Starbucks will comply with the letter of that black-robed thug’s ruling but not the spirit. Perhaps “reduce hours” - have one staff member go from store to store, opening each for one hour per week. How would the totalitarian class respond to that? Or do thugs get to demand specific store hours too?

If Starbucks has a contract to keep the stores open he can. I suspect that the truth is different from the hyperbolic rant couched as news.

WTF, indeed. Where in contract law does it say that one party must consider the impact on the other party? Is there an explicit clause in Starbuck’s contract with Simon Properties that prevents it from shuttering stores?

This is a dangerous precedent with totalitarian lefist overtones, but I’m having a tough time being upset over it happening to Starbucks, they helped make this bed. Now they can lie in it.

Late to this party.

But I suspect the ruling was not quite what the article said it was. If there were leases, and Starbucks was looking to violate the lease, maybe.

If I am wrong, then the facade of private ownership is gone. If I was Starbucks I would just lay everyone off and refuse to staff them.

Judge Heather Welch

I hate to seem sexist, but in all my years, I have never read or witnessed a female judge who stuck with the law and the Constitution, with rare exception when doing so agreed with their feelings. Their "Opinions" meant exact that... and nothing more.

Close the stores anyway. Let the dingbat judge enforce her ruling. Otherwise the taxpayers will be paying Starbucks for every minute these places stay open beyond what they intended.

Yes, another judge derelict in his duty to his oath of office. Malls are done for, as America has moved on from the 1970’s retail world, but this robed a—hole thinks he can hold back the tide.
