Mistake. Should have said they are artists and only accept contracts they are artistically interested in.

They did not discriminate against the “gay” persons. Had they been asked to do a photo shoot for any number of events/gatherings for the “gay” couple, they wouldn’t have objected. It was not the “gay couple” that they refuse to serve, it was only the activity, the “gay wedding” that their conscience would not let them serve. They should win their case, eventually.

This is going to be a drawn out, Courtroom by Courtroom battle. Unless the other side (conservative) begins winning some big bucks in damages.

The term "public accommodation" in Civil Rights legislation was originally supposed to be limited to key products and services such as restaurants, hotel/motels, and gas stations, i.e. businesses that everyone needed to take advantage of if they were on the road away from home.
There were discussions among the congressmen, and specific congressmen only agreed to support the legislation with the understanding that "public accommodation" would never apply to all businesses.
Of course the penumbras of liberal stupidity and cupidity have now been allowed to envelop all businesses making a mockery of the original intent of the Civil Rights bills.

Let's say Westboro Baptist Church comes to town to hold one of their "God Hates Fags" protests at a local military funeral, an activity that
the United States Supreme Court has held is their Constitutional Right.
They try to hire a gay caterer to cater their protest, a gay t-shirt printer to print "God Hates Fags" T-shirts for them to wear, and a gay videographer to make videos of the protest for promotional DVDs.
None of them can refuse either, right?

Give them what they want. Video their wedding and shoot just the guests. Shoot videos do all the guys butts. Want a cake? Make an ugly vulgar cake. They want to force people to use their artistic talents? They want to ruin their day, how do you prove it is not just artistic interpretation.

I wonder if the Judge would order a Jewish baker to bake a swastika cake for a bunch of Nazis. Or does he just order people to do things for the groups who are the fad of the day.

i think it’s bad business for any small business owner to outright REFUSE service to a potential customer. What you do is quote an outrageous price and/or impossible schedule. Most of these “customers” will go away muttering about a “ripoff”, and animosity and lawsuits are avoided. Should the customer take the deal, then you make a pile of dough. Most smart business people know this.

...and they sought to post a notice on their company's website that they won't shoot same-sex weddings, based on their religious beliefs, according to the motion to dismiss. Really that's the solution to all this, and it should be made legal. Forget discrimination laws and what have you. If a business does not want to cater to a specific segment or segments of society then let them clearly state as such and then let the market sort it out. Telescope Media doesn't want gay clients for religious reasons. They want to clearly state that on their website. Why not legally allow them to do so? People put off by their position can and will go elsewhere. People who support their position will bring their business to them. And the market will decide. Allow anyone to do it for religious reasons or any other reason with the only requirement being that they clearly post their preferences in their store or on their website.

I defy anyone to show us where it was the intent of the Framers of the Fourteenth Amendment to provide equal rights for homosexual behavior. It’s passage through the Congress was quite extensive.
