Executive Order that Could Cause Millions to Self-Deport
The Federalist ^ | 09/14/2017 | David Barulich

This idea to use the tax code as a method for getting businesses to replace illegals with legal workers is amazing! Trump could do an executive order and put this in place immediately.

It's even better than building a wall because a border wall doesn't do anything about the illegals who are already here. This article describes something that would cause millions of illegals thrown out of work to deport themselves. No ICE round-ups necessary. No need to wait for Congress!!!!

A total embargo on $$$ going into California might be a start.

The main reason why an E/O like this won’t work is the judicial jerks in our federal courts.

They were the idiots that shut down Arizona SB 1070. They were the idiots that shut down Trump’s immigration orders.

And they sure as hell would declare any measure of this type as illegal before the ink would even dry.

Our nation is being run by ayatollahs in black robes.

Don’t hire undocumented, don’t rent to undocumented, report undocumented in the courts, schools, hospitals, etc.

I am sure there a laws on the books demanding just that. If those would be enforced... who needs a wall?

Americans who are complicit in breaking these laws must be charged and fined as well.

Illegals don’t care if they have drivers licenses.

Some drive cars without them, some ride bikes or use public transit.

But you are absolutely right about public assistance. People have no idea of the huge amounts of money that illegals take. In California it is in the many billions.

AMEN

Take away their methods of survival on our tax money.

Forget about ‘compassion’. How about some compassion for the taxpayers???

We need to do whatever we can to encourage illegal aliens to go home.

Illegals have working off the books down to a science. And they use fake CA drivers licenses and stolen SS numbers.

I worked for a company that used e-verify nationally. It was required if you wanted to do government work (Construction).

Most of us figured we had some “illegals” working for us. But we were legally helpless. Here was the problem. When a person applies for the job and fills out the form and says they are a citizen and presents a SS# and card and birth certificate and shows ID and then PASSES e-verify, It’s a dangerous thing to accuse them of identity theft or fraud with fake documents.

Our HR manager confided in me that we had some workers whose age and photo ID were pretty suspect for what they were presenting. BUT, legally, if they took any action, it could be considered discrimination. These were construction labor positions, so it’s hard to disqualify someone on skills.

The E-verify system is supposed to be fool proof and is controlled by the government. So you essentially take the liability off the business if they should have someone that uses a legitimate ID.

My wife and I hire a cleaning lady once a week. She is an American citizen in her mid fifties. We are more than glad to pay her fee. Some things are more important that cheap labor!!!

Only works if all government assistance is cut off, too. Food stamps, medical services, housing and even education.

If federal welfare funds are for citizens only, then we could indict local welfare officials who allow illegals to get benefits.

“They can overturn the multi-billion dollar concrete wall by handing visas to everyone at the door.”

Well then you shouldn’t have any objection to building the wall since you think it won’t work anyway.

Government assistance should be what it was originally meant, the truly handicapped, and truly needy elderly. Teenage baby factories and self dosing drug addicts not so much. Welfare should have a time limit where one is expected to work and get themselves educated. There are jobs some Americans don’t want to do, tough s#!t fellow citizens should not be subsidizing lazy bastards!!!

“I see a great many sub contractors operating as a corporation these days. How do you e verify an s corp? How could illegal immigrants own one?”

Generally what happens is that a subcontractor who is legal owns the s-corp and he hires the illegals so there is a buffer between the legal business and the illegal labor. In that case, nothing really changes as the subcontractor would be on the hook for all the taxes due on that labor he can’t deduct as expenses. He would go out of business and in debt to the IRS instantly if he is trying to run it as a pass through and this regulation went through.

Very true statement about nannies, house cleaners, and landscapers. The real problem for the landscapers, and those that hire house cleaners, is that there are not enough people who have the gumption to actually work at entry level jobs. Too many opt to collect welfare with all it’s benefits to actually work for a living. Other’s collect welfare and get money “under the table” as well as landscaping and cleaning houses. People will always find ways to cheat the system. Sad for those who actually work and report their income to the IRS.

We have been hiring teenagers to cut our grass and clean our house when we are unable to do it ourselves. There is always a teenager willing to make some good money.

Well you’re in for a rude surprise. The laws prohibit discriminating against illegals, and those laws are enforced.

The government has been enabling and rewarding illegals for decades.

Unlike liberals, I don't believe that money grows on trees and that the billions of dollars it will take to build a wall must come from somewhere. If we are going to have solutions that don't work, we might as well go with the cheapest one. We've never even tried enforcing our laws. Maybe we ought to look t doing this before a multi-billion dollar wall?

Anyhow, why not a minefield? It's probably an order of magnitude cheaper than a wall and immensely more effective.

An S Corp CANNOT have so much as a single shareholder who is a non-citizen.

OTOH, a Limited Liability Company (LLC) can - and the legal protections and tax treatment of each is essentially the same. All that someone needs (the GC, not the illegals) is a decent corporate lawyer, and some basic forms to know to use an LLC and some very basic forms to create one, and they can work around the S Corp restrictions.

WRT the topic of this thread, I favor 2 things:

1) A wall that cannot be removed with a piece of paper; and

2) The prosecution of 1 large, 1 medium and 1 small company in every state. That’s just 150 prosecutions, I think that the DOJ can handle it. Prosecute them for breaking existing laws by hiring illegals. Put a few execs in jail (the bigger companies) or fine them heavily (small and medium companies), and this crap of hiring illegals will end faster than $hit goes through a goose.
