Video shows Utah nurse screaming, being dragged into police car...

A nurse says she was assaulted and illegally arrested by a Salt Lake City police detective for following a hospital policy that does not allow blood draws from unconscious patients.

Footage from University Hospital and officer body cameras shows Detective Jeff Payne and nurse Alex Wubbels in a standoff over whether the policeman should be allowed to get a blood sample from a patient who had been injured in a July 26 collision in northern Utah that left another driver dead.

Wubbels says blood cannot be taken from an unconscious patient unless the patient is under arrest, unless there is a warrant allowing the draw or unless the patient consents. The detective acknowledges in the footage that none of those requirements is in place, but he insists that he has the authority to obtain the draw, according to the footage.

Just to note, the unconscious person the officer was trying to obtain a sample from was a victim in a crash. He was hit head-on by a perp the police were chasing. Explains why there was neither a warrant, nor an arrest for the unconscious victim.

It also explains why the cop was so anxious to get something, ANYTHING, which would put the victim at fault. The patient, an innocent bystander, was injured as a result of the police chase. A lawsuit would logically have been forthcoming, and the cops would have been hit for endangering the public by their decision to perform the chase. The cops WANTED some drug offense to hang over the victim's head to blackmail him into not suing.

Sure, any case based on an illegal blood draw would be thrown out of CRIMINAL court, but the trucker would still face losing his commercial license and being fired and blackballed. The cops wanted blackmail leverage.

The “I gave you an order!When a police officer gives you an order you comply or you can go to jail!” attitude. There are many cops who believe that their authority overrides any law or Constitutional Rights of the the citizens. I believe it begins early in the training process when they are taught assert your authority early and often and intimidate the person into obedience and relinquishing their rights. Remember it’s not protect and serve, it’s order and control and punish those you disrespect your authority, that’s the job of a police officer.

Not necessarily. If you have issues with the evil cops, take it up to the court — later. Do NOT impede or interfere the law enforcement, if you value your life. Inadvertent suicide by cops can happen when you interfere with their work. Stupid nurse.

Yep. Cops used to be “Peace Officers”. Now they are “Law Enforcement Officers”. Big difference.

Correction — she will take the taxpayers to the cleaners. Cops don’t pay the lawsuit settlements. The city does.

The cop needs to follow the law like everybody else.

It's obvious to me he just lost his temper and went after the nurse in an inappropriate, aggressive fashion, unwarranted for the situation.

If the cop has a valid request, where is his warrant? Where is his documentation? Where is his legal authority?

The nurse should sue the bastards for everything she can. This is not how civil society operates. He was wrong. She and her boss showed him that they had the law behind their decision not to draw the blood from an unconscious person.

The video tape is damning evidence against the cop. He should lose his job over this.

If you’re arrested, just don’t cause the situation to deteriorate further. Don’t comply and you risk being arrested. There is nothing you can do about it. No screaming can get you off. The only course of action is to comply. You can seek legal actions LATER, not during the time you are being arrested.

Except that drawing the blood would constitute, IMO, I’m not a lawyer, assault in itself. This puts the nurse in a bad position.

There is no difference. There can only be “peace” through the rule of law — law enforcement is the way to achieve it. “Law enforcement” is the core responsibility of any officer of the law.

Ah, that’s a most interesting point! If (and that’s a big if) the driver falls under the federal law you referenced, then it was the cop’s responsibility to make that clear to the nurse.

Allegedly, the detective was following orders of his lieutenant back at the station, so it's the lieutenant who is ultimately responsible for this fiasco. What the lieutenant should have done is fax the relevant federal law to the hospital, and the hospital's lawyer, and THEN the detective could say "Under the federal statute you have in your hand, I have authority to demand a blood draw". The nurse could then comply without placing herself and the hospital under legal risk under HIPPA.
