Marcellus Williams faces execution despite new evidence

On Tuesday night, the US state of Missouri is planning to execute Marcellus Williams despite a new report from a DNA expert that his lawyers argue supports his claim to innocence.

In 2001, Williams, who is now 48, was convicted of the 1998 killing of Lisha Gayle. But his lawyers say new DNA evidence could exonerate him. The Missouri Supreme Court, however, has refused to review that evidence.

Williams' lawyer, Kent Gipson, has described the Supreme Court's decision as "baffling".

"We petitioned the court to look at the new evidence on August 14th, and less than 24 hours later they decided based on the court files that the execution should go ahead anyway. This is unprecedented," Gipson told Al Jazeera.

Williams, who has always claimed he is innocent, was sentenced to death in 2001, three years after Gayle, a former newspaper reporter, was murdered in her home in a gated community in St Louis, Missouri. He was originally due to be executed on January 28, 2015, but Missouri's high court decided to postpone the execution to allow time for new DNA tests to be conducted.

Those tests showed that the male DNA on the murder weapon, a knife, was not Williams' but belonged to a third, unknown person.

"There is no physical evidence, no eyewitnesses that directly connect Williams to the murder, the DNA on the weapon wasn't his, the bloody footprint at the murder scene wasn't from Williams' shoe and was a different size, and the hair fibres found weren't his," said Gipson. "It was someone else that killed Gayle, not Williams."

How was Williams convicted?

During Williams' trial, the prosecution based its case on the testimonies of two people, Henry Cole and Laura Asaro.

The article is purely from the vantage point of the defense. The issue is raised over how prosecutors dismissed all but one of the potential black jurors. Guess what. Attorneys on both sides have the right to ask questions and dismiss potential jurors. Who knows the specific reasons a lawyer does so? But, as a percentage of the US population, one or two black jurors is about the average.

The job of juries is to pursue justice. Not social justice. Not racial justice. Just justice. Societal ills are not supposed to be under consideration. Fairness is not the issue. It’s justice.

Anyone who thinks that a colorblind jury is not possible is also incapable of believing in or supporting a colorblind society and the full equality of human beings without regard to race.

Those who reject these basic principles of our free republic, need to extricate themselves from it.

This is one of the reasons I believe the Death Penalty can be just, but I still have significant reservations about it.

An injustice can't be undone after the Death Penalty is imposed.

And a lot more people get railroaded by the "Justice" system than anyone is willing to admit.

I mean, how many examples do we have to be presented with before we acknowledge that fact?

Even pre-DNA that account is completely damning.

Does the defense have any kind of response to that?

And just WHAT DNA evidence "exonerates" Williams?

He was clearly there.

Any extra DNA evidence would only point to some kind of accomplice.

The guy is STILL guilty beyond any reasonable doubt, even with phantom accomplices, he's still on the hook.

Has it been contaminated since, degraded or lost?

Enough for a liberal judge to throw out the sentence or conviction.

Even if it doesn't go their way they still win.
