San Diego teacher refuses to answer Border Patrol questions at checkpoint

ell Middle School teacher Shane Parmely was detained for over an hour by Border Patrol agents at a checkpoint in New Mexico because she refused to say whether she was a U.S. citizen.

Parmely’s family helped her film the incident, which she posted Friday evening on her Facebook account in several segments that were widely shared. Parmely told Border Patrol agents that she believed she did not have to answer their questions. One agent showed her a card listing immigration law and a Supreme Court case decision that give Border Patrol agents authority to operate checkpoints within 100 miles of the border and to ask questions about citizenship without warrants.

“Citizens?” an agent asked her as she drove up to the checkpoint.

“Are we crossing a border?” Parmely responded.

“No. Are you United States citizens?” he repeated.

There was an informal one on I-15 going north. Had to travel that frequently when doing work at Ft. Irwin. BP would slow you down, and in my case where driving a rental T-bird or whatever, bounce the trunk to check for the weight of stashed Mexicans, and that was it. No lined up mile of cars like at Camp Pendleton.

She was not crossing the border. The Border Patrol has checkpoints which have permanent structures on various roads leading out of El Paso. There is such a checkpoint on the westbound I-10 somewhere near Las Cruces, NM, and a checkpoint on the eastbound I-10 near Sierra Blanca, TX.

A few years ago I flew into ELP airport and rented a car to drive up to the races at Ruidoso Downs, NM. I had to stop at a Border Patrol checkpoint near the TX-NM border south of Alamagordo. The uniformed agent looked surprised when I told him I was on my way to the races.

It is a little troubling when you are obligated to answer a policeman’s questions as to where you are going when you have not crossed a border and there is no probable cause for a policeman to have to speak to you. However, I do respect the work of the Border Patrol and the fact that it is extremely thankless.

We live in ‘interesting times’ having at least 50 million illegals and their anchor baby demon spawn in the country...An invasion.

I’ve softened my position on presenting ID...We’re in a war for the survival of what is/was America.

You cannot avoid the checkpoint on the 10 freeway in west Texas. It is designed that way. And they do catch illegals on buses.

Maybe not but they should have to prove they are American Citizens.

Better yet, throw her in the Taco wagon with some gang members for transport.

Well, I understand people not liking being asked for “papers” just out of the blue but, come on. Use some common sense.

This is not like Nazi Germany and you know it. You know what they are trying to accomplish. You realize how close you are to the border and how many illegals stream into the country every day. Just show them your license or whatever and go on down the road. This is not a hill to die on.

Hopefully they will have a many feet tall assistant at the border soon. And no I’m not some cop asskisser. This is a very unusual situation. Help them do their job - a job you likely wouldn’t want to have.

I told them at the Oregon border that I probably had Oregon lettuce in my teeth. Then I told them if they were really serious, they would make everyone take a laxative at the border, then have someone make sure they cleansed befor crossing.
He didn’t get my Georgia humor and sarcasm.

The BP needs to have a better process for identifying illegals, and that is best done down at the border. Just telling the BP Officers you “are a citizen” without any proof of same is BS.”

The officer quoted the law to her and the affirmation by the Supreme Court.

If you disagree with the laws of the United States, contact your Congressman or Senator. Join an advocacy group. Run for office. BUT, in the mean time you MUST obey the law or face the consequences.

Back in the day when it was easy to enter the U.S. from Canada (ask Ted Cruz), the border patrol would ask each person in the car, “where you were born”. No big whup. Living in Rochester, NY we would travel to Niagara Falls or other places in Canada fairly often. I never felt abused or put upon by border agents asking me “Where were you born?”

This snowflake woman, with a man’s name, is an A$$. Fortunately for her, in this country you have the right to have a man’s name and to be an A$$.

I, my LE days, I worked side-by-side with Border Patrol and INS personnel in the 60’s and they were dedicated and hard working employees. They don’t fool around, they followed the law. We ran several cases together and drank a few beers.

I’ve got to side with the teacher on this one. Asking citizenship when crossing the border? Fine, I don’t have any problems with that at all. But stopping and asking miles from the border isn’t fine. That smacks of a “show me your papers” totalitarian regime.

Wherein it regards the Constitution, the Bill of Rights and the 5th Amendment:

...nor be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty or property without due process of law.

Questions can be asked, no one is required to answer them.

Obey the law yes. They may be lawfully operating but it is also perfectly lawful to refuse to answer questions.

For about a year and a half, I lived in Tucson and worked 3 weeks at a time in southern Sonora. On the way home, I always found it annoying to be stopped at the Border Patrol checkpoint between Nogales and Tucson, since I had just gone through customs at the actual border, so I’d often answer their questions in Spanish for my own amusement.

I wouldn’t refuse to answer, though. At that point, I just wanted to get home.
