Clinton-Era Memo: A Sitting President Can Be Indicted

A newly-obtained memo written during special counsel Kenneth Starr's investigation of President Bill Clinton rejects a commonly held view that a sitting president can't be indicted, The New York Times reported.

The discovery adds a possible new wrinkle into the investigation into Russia and President Donald Trump's campaign.

The memo has been locked away in the National Archives since 1998, but was obtained by the Times' Charlie Savage through a Freedom of Information Act request, and represents a thorough analysis of the opinion, the newspaper reported Saturday.

According to the findings, the memo concludes that "no one, even President Clinton, is above the law" and says it is "proper, constitutional, and legal for a federal grand jury to indict a sitting president for serious criminal acts that are not part of, and are contrary to, the president's official duties."

Ronald Rotunda, a prominent conservative professor of constitutional law and ethics, was assigned to write the memo when deputy prosecutors told Starr they had enough evidence to send to a grand jury against Clinton. The prosecutors also compiled a draft for an indictment against Clinton.

The Times has also put in a request for that, but the National Archives is still determining if the document could fall under secrecy rules for grand juries.

Starr's findings were not the first time a special counsel had determined a sitting president could be indicted. Watergate special counsel Leon Jaworski, in 1974, also got a memo from his staff saying then-President Richard Nixon could be indicted.

Starr, as well as Jaworski, chose to allow the matter proceed to impeachment, rather than indictments, but the memos bring up a possibility that former FBI Director Robert Mueller, in charge of the Russia investigation, could have options allowing him to proceed with a criminal case.

Yes. Exactly. And an FBI Director doesn’t personally supervise investigations in any case. That is the job of the Deputy Director.

I can see Trump’s supporters coming out in mass protests. Next, the Leftists move in to attack Trump supporters — with the police allowing them to do so. Finally, Trump supporters fight back. HARD.

Who would the police, national guard, and military fire upon?

I’m starting to see parallels with the old Austro-Hungarian empire. They had language and ethnic and religious groups all cobbled together. And it worked OK until some of the groups decided that they really, really needed to assert their own special identity. And all of a sudden none of it held together any more.

I think the East coast of the US, the West coast, and parts of the Great Lakes could actually splinter. People of one sort could end up being chased from this region into that region.

A house divided cannot stand.

To consider that the president of the United States cannot be charged for a crime while in office is to create a king or an Idi Amin style dictator and I cannot believe that any red-blooded American would agree with that idea. If such a thing would officially be confirmed then I would definitely agree with those on this forum who hold that our country has sunk to the level of a banana republic.

When I was in high school back in the 60's I was taught that a sitting president could possibly be indicted BUT the indictment must be sealed and remain top secret and should be considered a national secret UNTIL that president left his/her elected post upon which time the indicted would then be unsealed and s/he could be possibly prosecuted.

The same sort of law existed in ancient Rome. It's one of the elements that helped destroy the republic. Opponents would charge their political enemies with crimes knowing they would be prosecuted upon leaving office.

Well, the Felons Clinton were BOTH above the law. So this memo is Bull0bama.

The liberals have been planning on this since the day that we elected Donald J. Trump as our president.

On the other hand, I don't imagine that they were planning on dancing in the Spoandau Ballet under the DC cherry trees, like they're gonna end up doing if they skin this "removal" smokewagon...
