Big news hiding in Nina Totenbergs story on Justice Gorsuch voting 100% with Justice Thomas:
But it is unlikely that Kennedy will remain on the court for the full four years of the Trump presidency. While he long ago hired his law clerks for the coming term, he has not done so for the following term (beginning Oct. 2018), and has let applicants for those positions know he is considering retirement.
Kennedys position on the court is more than consequential. In the most hotly contested and closely divided cases, his vote often decides the outcome. With every passing day, it has become more clear that President Trumps first Supreme Court nominee, Neil Gorsuch, is probably even more conservative than the justice he replaced, Antonin Scalia.
This would put Justice Kennedys retirement right before the 2018 midterms, giving the Republican base reasons to turn out and keep the Senate with a Republican majority (already a strong possibility in 2018).
Hell be able to go out on a high note, deciding the fate of partisan gerrymandering, gay rights, and who knows what else.
UPDATE: Republicans in the Senate would have a strategic decision to make: try to confirm a replacement before the elections, or use it as a tool to boost midterm turnout.
The lower court appointments are just as important. Obama was too lazy to fill them and Trump is appointing them like a fire hose. Very few cases go the distance to SCOTUS. Keep filling vacancies. I thank God every day Hillary lost
My guess is feet first. It’s good to be virtual monarch.
Can you point me to that?
She will die before she resigns.
If I understand you correctly -- I would certainly mind. I would prefer a justice that is a swing voter like Kennedy to a hard leftist like Ginsberg. The Trump presidency is an opportunity to replace as many hard leftists as we can and I hope that happens.
You don’t understand.
Kennedy is a liberal.
Tthe media calls him a moderate or swing vote so they can call Ginsburg, Sotomeyer etc liberals- instead of kooks or radicals. Which is what they are.
:-)
I don’t care what the MSM says or labels. Kennedy votes less liberal than Ginsberg. So there are degrees of bad and degrees of being a liberal.
Your post seemed to imply you preferred a hard leftist like Ginsberg to Kennedy ... and that is the only reason I responded. I want Trump to replace the hardest leftists on the bench. Kennedy is a lower priority for me.
The Winning, it just a keeps on comin'!
ROFLMAO
The 21st Century’s “Dewey Defeats Truman” moment.
Good riddance. What a disappointment.
Yep. The damn *itch will only leave feet first. She will stick it out until she croaks during a hearing. I would love to pee on her grave.
The modern Dewey/Truman headline.
Just in the first four years.
Not necessarily.
How many lesbians have you known that did not abuse drugs as part of their lifestyle, and how old is Kagan?
Statistically she is not looking at a seventy year expectancy.
This is why they are going so crazy.
The SC is where all the battles will be fought.
And when it’s stacked with far right conservatives the game is up for the left for possibly 4 decades.
Shhh.. Yup.. Imagine if it went bad..
a couple of things i really like about this report:
1. Clearly President Trump done REALLY good with the Gorsuch appointment! Looks like Trump totally knocked this one out of the park! (I still remember the nattering nabobs of negativism whining about Gorsuch’s wife going to a liberal church, and how that basically meant Gorsuch just HAD to be a sellout.)
2. I like the fact that REASONING is used to explain the SPECULATION that Kennedy could retire in a year, namely the bit about having (SUPPOSEDLY) let applicants for those positions know he is considering retirement.
Wasn’t Gorsuch identified as a volunteer usher in said church congregation?
That said, a Christian by conviction might have a number of reasons to hang around a legacy church. This deserves more than a skin-deep look. If they have open gays there, maybe he believes he can be an agent of God to win them back to the straight and narrow with the Lord. I’d want to explore that theory before writing off the whole thing.
Thomas, whom Gorsuch seems to be echoing, is quasi-libertarian anyhow. We could do worse than constitutional libertarian votes that still don’t endorse arrant nonsense.
