Schumer ready to leave Supreme Court seat open

Sen. Minority Leader Chuck Schumer (D-N.Y.) said on Sunday that he is prepared to leave open the ninth seat on the Supreme Court.
If the nominee is not bipartisan and mainstream, we absolutely will keep the seat open, Schumer told CNNs State of the Union.
ADVERTISEMENT The Supreme Court vacancy has been open since last February, when Supreme Court Justice Antonin Scalia passed away.
Schumer said he is prepared to fight "tooth and nail" should Trump not choose a mainstream nominee.

Chuckie is having a "I have Power" moment. It will be short lived. Better to have a 9th than risk upholding lower courts.
He's not thinking this through.
I believe the pick will get all the Repubs.
The Dems may not like the new found power of Schumer and creating a stand off when they know one of his picks is taking the bench.

Dems hoping for the death of an additional SCOTUS conservative had best keep an eye on their own Ruth Buzze Ginsburg, who is in extremely frail health at age 84.
Liberal justices who vowed to outlast a conservative Presidency have never succeeded, IIRC.

Very simple way around this...
just have the Senate vote to recess for a day and during that recess, President Trump makes a Recess Appointment of whomever he wants and that new Justice will serve two years before he comes up for Advise and Consent from a new 2018 Senate that should have more new Republicans members to beat a future Democrat filibuster.

There’s nothing magic about 60 votes for SC nominees. It’s a Senate rule, nothing more. It can be changed to a simple majority vote, by a simple majority vote.

The vote to confirm a Judge has to be 2/3 AYE?
If the Court is 4-4 split now and a Liberal Judge goes down the split would be 4R-3L?
If that were to happen, would “The Head Democrat Clown, be happy?
By my thoughts are, Chucky is not going to be happy, for a looooong time!

You can pretty much count on McCain and Graham going against Trumps picks. Because of them, the Republicans DO NOT HAVE A MAJORITY.
Our only hope is that they each have to resign. Only then will we have a majority in the Senate.

You know, if the Pres could work out a deal with Mc Connell,!if Chucky Cheese persists, of having the Senate go into recess for a day an put his nominee in as a recess appointment... In 2018, so many donk incumbents are up there could be 60 GOP sens in 2019, then the point about a filibuster would be moot
