“The sort of person who wouldn’t take their civic duty seriously and vote “not guilty” for a black accused of murder probably already has a felony conviction of his or her own and is ineligible to serve jury duty.”
You mean like the person on the Michael Slager jury who allegedly said that under no circumstances would he vote to convict?
Did he have a felony conviction?

About 36 years ago I had a female federal prosecutor tell me that in the late 80s they were already experiencing difficulty in getting inner-city black jurors to convict African Americans for black on white crimes.
This article is a scurrilous attempt to justify what is evidently a growing trend which is repugnant to the rule of law but which, regrettably, already exists.
Just another example of diversity being our strength.
That’s where the problem is. He is assuming that all other races will go along with this instead of each race protecting their own...which is the likely outcome of this stupidity. As usual, a liberal idea that is not thought out.
A co-worker of mine is African-American. She was put on the jury of a high profile murder case. The defendants were black. The evidence was compelling.
Like most African-Americans (despite their general voting patterns), she saw the evidence spoke for itself. She led the jury in returning a guilty verdict in the time it took to go over the paperwork and fill it in properly. She then decided to get a gun and learn how to use it.
I don’t believe she is a conservative in any sense that we are, but she has a brain in her head, and personal decency. She doesn’t write articles, and she doesn’t read the articles that would exhort her to nullify a murder.
And she was the foreman.
Can’t argue with that. It’s my take as well.
LBJ did Blacks no favors here, and as I understand it, it took Republicans to get the things passed.
Democrats wouldn’t do it on their own.
They do not have a clue what they are asking for do they? They kill each other way more than anyone else does. So the perp is black....the jury lets him off, i am thinking the victim is too.
They want to kill whitey.................they think everything will be better without whitey. Look at Oakland, Detroit, St Louis...the list goes on and on.
And white people wouldn’t start doing the mirror-image thing?
Where was he in 1995?? I thought Blacks already understood the power of jury nullification after O J Simpson was found not guilty. It happens all the time.....Blacks getting acquitted for assault, etc, of Whites. Heck, most of the time they aren’t even arrested for ‘playing’ the knockout game, are they? And the big trials, like the one where Channon Christian and Christopher Newsom were tortured and murdered, don’t ever get national coverage. This guy must live in La La Land.
You can’t generalize from one specific example. In order for Mr. Mystal’s plan to work, you need to have a large pool of people willing to do this in order to ensure you have at least one on every trial involving black on white crime.
The guy is a racist, pure and simple.
I can confirm from personal experience what your federal prosecutor friend stated. There is a “black code” out there, and it’s real meaning is not what you will find in a Google search. Like so much truth, it has been suppressed for its lack of political correctness.
The “black code” posits that when any black person is in a dispute with a white person, it is the duty of all black people to rally to the defense of the black person. The objective merits of the black person’s position or the wrongfulness of their cause is irrelevant. Blacks must stick up for blacks.
Someone probably used jury nullification in the Slager trial in South Carolina, but I’m guessing Elie Mystal wouldn’t agree with nullification in that instance.
Yes...
They’ve been doing it for decades. Ever hear of OJ Simpson?
I think we can all find examples of jury nullification based on race with both black and white jurors deciding the fate of a defendant based on race.
As for when jury nullification based on race started, we might want to look back at an era in our history when only people of one race were allowed on juries.
