Opponents of the recount are also claiming that because an order issued by U.S. District Court Judge Mark Goldsmith early Monday morning to start the recount immediately only dealt with the timing of the recount, state courts are free to rule on whether the recount could continue.

Judges on the panel were skeptical of that argument, jokingly asking attorneys representing Trump and Schuette's office whether they were willing to go to jail for them for violating a federal judge's order.

According to this it is not quite over yet. But perhaps it is only a formality before it is over.

The combined effect of the two rulings appears to set up further court proceedings in front of Goldsmith and the Michigan Republican Party has already filed for another federal hearing.

“The Michigan Court of Appeals ruled in our favor, determining that the petition for recount filed by Dr. Jill Stein should have been denied,” said Ronna Romney McDaniel, chairwoman of the Michigan Republican Party. “Dr. Stein is not an aggrieved candidate as she has no chance of winning the election in Michigan.”

Attorney General Bill Schuette said: "I’m grateful, and I know Michigan taxpayers agree, that the Michigan Court of Appeals has adhered to the rule of law," given that estimates of the cost of the recount are as high as $5 million -- more than $4 million more than the fee Stein was required to pay.

Andrea Bitely, a spokeswoman for Schuette, said the Michigan Court of Appeals said that “there is no conflict between” its order and the federal district court’s temporary restraining order, so the recount should end immediately.

"To ensure clarity for Michigan taxpayers, (and as recommended in the Sixth Circuit’s opinion issued this evening), the Attorney General is now filing in the federal district court a motion to dissolve the temporary restraining order," Bitely said.

We are still doing the recount here in Michigan.

And filing with the jerk judge Goldsmith to try to get it stopped.

Many think this will be a smooth and easy thing to accomplish. I am taking a more wait-and-see attitude because from the local news and commentary it is clear that this jerk judge is in this for marxism, not fairness. IOW, he likes being a FEDERAL judge telling states what to do.

Did you see that most of the Clinton areas cannot be recounted because the totals don't match?

Why do I not find that surprising?

I don’t think so but we do have a very very rapidly moving bill in process to force Jill Stein to pay for it all.

Her fee was something like half a million. Estimates are that this recount could be as high as $12 million. Taxpayers are getting screwed.

Yes they have filed for another federal hearing and in the meantime the recount is on.

See my post above about them joking about going to jail for violating a fed judge order. So the recount continues.

Some think Goldsmith will just say oh sure, stop the recount. Let's just see if that happens. I hope I am wrong in thinking it will not be that easy.

FROM MI GOP FACEBOOK: LANSING, Mich., Dec. 6, 2016 – Michigan Republican Party Chairman Ronna Romney McDaniel issued the following statement regarding the rulings of the Michigan Court of Appeals and the U.S. 6th Circuit Court of Appeals:

“This is a win for Michigan taxpayers. The Michigan Court of Appeals ruled in our favor, determining that the petition for recount filed by Dr. Jill Stein should have been denied. Dr. Stein is not an aggrieved candidate as she has no chance of winning the election in Michigan.”
The U.S. 6th Circuit Court of Appeals made clear, in their ruling, that “If, subsequently, the Michigan courts determine that Plaintiffs’ recount is improper under Michigan state law for any reason, we expect the district court to entertain any properly filed motions to dissolve or modify its order in this case.”
