Letter from DU attorney on why Comey reopened investigation (CYA)

Comey knows that Hillary is going to win reelection. He knows that Rs in the House will very likely rake him over the coals in endless Benghazi like hearings. Comey testified under oath to Congress that he would reopen--or at a minimum reconsider--the investigation should he get additional information. He also testified that if there is a referral from Congress regarding Clinton's untruthful disclosure to FBI that he could open an investigation vis her FBI interview.

Somebody in the know dropped some emails in the FBIs lap recently. (Part of the Weiner investigation maybe, I'm not buying it) This puts Comey in a box. He testified under oath that he would relook at things if more information comes to light--so basically he's in legal trouble (perjury allegation) if he doesn't.

Further, if he didn't send the letter he sent today, he would be accused of political collusion with the Clintons. He's covering his ass. Plain and simple. He has bristled at the allegation that he is acting in a partisan way, and this (nothing-burger) letter is his attempt to get back to some type of perceived neutrality in advance of his anticipated testimony to Congress. Imagine if he didn't send the letter. You can just see Gowdy screaming at him, "So you had these additional emails and you kept them a secret until AFTER the election!"

My legal advice to people here is to take a deep breath. This letter is classic CYA. It's designed to protect Comey, and that's it. If he had the goods on Clinton the shoe would have dropped today. PS, watch for any and all oppo that the Clintons have to be released today and tomorrow in advance of the Sunday shows. Anything they have on Trump will come out now. The best defense is a good offense. Let's all strap in and kick this orange bastard's corpulent ass.

Couple people have asked about what the oppo probably is. Here's my best speculative shot..

Absolutely no way someone as careless as Donald Trump has not been surreptitiously audio recorded. In the modern era, everybody has a smart phone. Odds are its an attractive contract vendor who was not required to sign a non-disclosure contract. You can guess what would be in the recording.

Is that legal, you ask? New York's wiretapping law is a "one-party consent" law. New York makes it a crime to record or eavesdrop on an in-person or telephone conversation unless one party to the conversation consents. N.Y. Penal Law §§ 250.00, 250.05. So, while I'm not licensed in New York, if the party recording was in the room, the answer is pretty much it looks to be legal.

The person with the recording has probably already consulted with an attorney, found out that it wasn't illegal to make the tape, and they are ready to drop it. Now's the time my friend. The address to the Washington Post is --- The Washington Post, 1301 K Street NW, Washington DC 20071

Donald Trump will be the next president and the whole Dem house of dirty cards will be coming down...and they know it. Comey is just the first and best informed to go into CYA mode.

You need to be concerned because the Hillary web is huge.

Exactly.

This is much more likely than a Clinton election ploy.

If Clinton wins, she owes him without this. The Republicans have been neutered.

If Clinton does not win, he is in big trouble without this.

Everyone has a hard time being truthful to themselves, but Democrats are especially good at lying to themselves.

You are completely wrong. Comey realizes Hillary will get beat by the Donald. His action gives the D’s cover for the reason she got pummeled in the election and Comey C’sHA.

Now the ball is in Obama’s court. Does he pardon after the election? He may not have a choice. The reason it is his only option is I believe the Donald will not choose to prosecute a former President.

Hillary will get heat from the MSM on one side while the slow drip of WikiLeaks heats the other. She could get so hot her cankles explode!!

The agents in the first investigation signed a draconian NDA, which threatened them with firing, loss of pension, and criminal prosecution if they revealed details of the probe. As a result, other than a few background stories about discontent among agents, Comey and his co-conspirator McCabe have been able to enforce silence with an iron fist thus far.

The information uncovered by the Weiner investigation may well be no more incriminating than what was uncovered in the first probe. The difference, however, may be that this set of agents have not signed the same ironclad NDA. This time, agents can threaten Comey and McCabe that they will go to the press with evidence unless an honest investigation is done.

I’m having a hard time (no pun intended) figure out why something on Weiner’s phone would incriminate Crooked.

I’m beginning to think that Rush may have been onto something when he suggested this may be something where they look into something quickly and exonerate her. This smells really fishy.

What if there is a full-blown revolution within the FBI that is fed up with Comey's cover-up. Some agents have already spoken to Fox anonymously expressing their displeasure about how the investigation was conducted. There was not unanimous agreement that a prosecution was not possible. Moreover, that is a decision for DOJ to make, not the FBI.

What if these agents gave Comey an ultimatum that they would go public with all the gory details if he did not reopen the investigation? There are rumors that the FBI did not destroy the laptops of Mills and other Hillary aides.

What if the FBI learned that Wikileaks is about to drop a bomb showing that Hillary lied and lied about her emails and that the information would lead to her arrest? Julian ASSANGE The next leak will lead to the arrest of Hillary CLINTON

What if the fact that a majority of Americans believed that the FBI should have convicted Hillary for the email scandal and that a corrupt FBI protected her?

What if the Wikileaks release of the Doug Band memo on the relationship between Teneo and the Clinton Foundation is a smoking gun that cannot be ignored and buried?

The pressure to reopen this investigation is not Comey's idea. He is being pressured to do so by his own people along with other events beyond his control. The initial "investigation" was a sham and Comey knows it.
