Ervin explained in her Facebook post that on September 19, "while in uniform, I made the conscious decision to not stand for the Star Spangled Banner because I feel like a hypocrite, singing about 'land of the free' when, I know that only applies to some Americans." Ervin said in the post that she was punished by Navy officials and that the "equipment I need to do my Naval job" was taken away.

When I was in boot camp at GLNTC more than 50 yrs. ago we were told that by enlisting we had given up our 2nd, 4th and parts of our 1st amendment rights. There may have been more, but it was a long time ago.

I read somewhere the she is an IS, Intelligence Specialist. A rating that requires a high security clearance, which she lost. Therefore she cannot work in her rating. As such, she should be busted and sent to the fleet as a Boatswain’s Mate. Let her chip paint for a while.
All you need to get through Navy boot camp is to be able to fog a mirror and walk.

That’s equivalent to violating a standing order. For a Petty Officer 2nd (E-5) to do something like that? Makes me wonder exactly WHAT she does in the USN? She clearly thinks the regs do not apply.

When in duty, in uniform she obeys the orders of the officers appointed over her and the US Code prescribes the treatment of the flag by members of the military.

Throughout the US Code the word “should” is used. Should means “obligation or duty”. Therefore, any officers present will violate the law if they do not enforce on the military those obligations and duties.
Civilians have no controlling officers, so their violation of the US Code is a violation of obligation or duty, but there will be no repercussions.

BM might suit her. I wouldn’t rate her at first. I would send her out somewhere as nonrated, and let her “strike” for something. I would keep her away from personnel records, medical care, or guns. Hell, I wouldn’t trust her to adequately perform fire & security watches.
