Ginsburg: 'Cooler heads will prevail' on high court nominee

Supreme Court Justice Ruth Bader Ginsburg said Wednesday that she thinks “cooler heads will prevail” in the Senate, where Republican leaders are refusing to consider President Barack Obama’s high court nominee.

Ginsburg told a group of students at Georgetown University Law Center that lawmakers should appreciate that a president can appoint justices anytime during his term.

“The president is elected for four years, not three years, so the power he has in year three continues into year four,” she said. “And maybe our members of the Senate will wake up and appreciate that that’s how it should be.” …

Congress is just following the Kerry Rule established by the Democrats that provides that a president should not appoint a Supreme Court justice in an election year.

Ruth Buzzi is right, a president can nominate judicial candidates at any time. The Senate, whose responsibility is to consider those nominees, is likewise free to schedule, or to not schedule hearings at its sole discretion. Cooler heads are already prevailing.

And the Senate is not under a time constraint either. The constitution does not stipulate a time period in which the advice and consent must be given.

Both Ginsberg and the author are wrong.

Ginsberg in that while a President can nominate whom they choose, the Senate has no obligation to act on that nomination.

The author in that it Ginsberg does not appear to have used the word “appoint.” When they can only nominate, not appoint, unless the Senate is in recess.
