Bad move there sir. Don't know if the gentleman had a ccw or not or if he had been to a course in Florida. When I took the class in FL they made a point of trying to make us understand that under FL law, if the perp is moving away, you had better no shoot because you WILL become the bad guy. I understood perfecly. If it ain't a threat, best not shoot. Sad situation.

That is correct. The elderly man appears to have made a bad move.

I was taught by a retired cop that if you shoot someone on your lawn or doorstep be sure to drag the body into the house.

In a SANE world this old man would be a hero for preventing another burglary and possible attack on other neighbors. But we don’t live in a SANE world anymore.

The old man should have said:
1. I feared for my life.
2. I thought he was maneuvering to shoot me.
3. And now I want to talk to my lawyer.

Bad move, Sir. Per usual, the anti-gun rights activists will run with this story to demand more "common sense" gun control, ad nauseum.

The guy potentially endangered other lives by shooting “across the street”. In my CHL class, we were taught not to do that. The instructor spent a great deal of time teaching us about collateral damage and liability.

Can’t shoot a fleeing perp under most circumstances.
Maybe if he’s armed and “maneuvering” against you.
But shooting at perp who is running away is got net you manslaughter at the very least.

His defense should be that his reactions are slow, he aimed the gun while the defendant was approaching him, then by the time his brain got his finger to move on the trigger the guy had turned away. Makes sense if the dude is old enough.

Any person with an ounce of sense realizes that in America 2016 A.D. the criminal element is favored. Do I have a problem with the idea of thieves getting shot while fleeing? Not really.

You need to know your local laws. In some places the use of deadly force is strictly limited to an immediate threat to life or threat of grave physical harm and limited to what a “reasonable (logical, well schooled in legal precedent, unexcited) man” would do.
In most jurisdictions (not all) someone running away from you is no longer a deadly threat, and the police should be called to try to settle things.
Ignorance of the law is no excuse. Yes there are places and reasons why you can shoot a fleeing felon, but you had better really know the laws before you do.

Article writer is spot on.
“Our firearms are for self-defense when lives are on the line, folks. Keep in mind that every bullet fired at another human being is likely to carry a cost with it in terms of time, money, and personal anguish. Never fire a shot unless you absolutely must to save lives.”
Also add:
“Every single bullet has a lawsuit attached to it”

1. This sounds like a bad shoot unless the perp had a firearm.
2. Shooter is very lucky the perp survived, downside will be a likely civil suit.
3. Shooter will probably achieve plea bargain and probation.
4. Shooter is a darn good shot, hit perp multiple times with a pistol from “across the street” which means probably 50-60 feet, and in a tense situation. That’s not easy, ask a cop.
