Marine who was court-martialed after putting up Bible verse at her desk loses First Amendment appeal in 'outrageous' federal court decision

A Marine who was court-martialed after refusing to take biblical verses down from her desk has lost her federal appeal, in a decision her representative called 'outrageous'.

Marine Lance Corporal Monifa Sterling lost a 2014 court-martial at her base in Camp Lejeune, North Carolina, based in part on her refusal to remove the verses.

She challenged that action but was told Wednesday that she had lost the case after it was ruled that the order was not a 'substantial burden' on her First Amendment rights, Fox News reported.

Absolutely it does. The house is on Government owned and operated property. Think of it as the biggest Home Owner’s Association in the country, if not the world. While living in such a home, the tenant cannot willy-nilly decide to paint a giant American Flag that wraps around the house. As good as it may look to some, it would not conform to the standard Haze Grey or whatever has been selected.

There’s always somebody to push the limits of tolerance, so suddenly, everyone has more restrictions put upon them.
Being a ‘rebel’ in the military is very risky. There are fragile egos at stake, and some will try to get even by making life a little more difficult for the ‘Wild Thang’.

She posted these in her workplace and was given a lawful order to remove them, she refused and there were other issues of insubordination.

She got what she deserved

So true. The "offender" was a O-3 that got riffed back to and E-5 and he was just occupying a seat so he could retire at the higher grade. He was the original role model for DILSWGAS.

And, you're absolutely right. Because of this clown, everything personal went, pictures of cars, dogs, wedding photos etc.

My point is this: is a right that can be so lost really a right?

She started with the right to freely contract, and did so in order to get into the Marines. She traded her rights for privileges at that point, voluntarily. Properly stated, she had no rights at all in the Marines, of her own volition.

Citations, please. There are no rights in the UCMJ. Officers can resign their commissions voluntarily, because their contract is an agreement to serve the Constitution. But enlisted agree to serve their officers and lawful orders, which is an agreement to a status of granted privileges and not rights.

Her Remington Raider fearless leader does have the authority to
tell an E3 to remove gigantic garish strips of paper like that.
If she was more clever though, she should have found some quotes
from the likes of Archibald Henderson, John LeJeune, Chesty Puller
Howlin’ Mad Smith, Presidents, etc. put them up and have her CO
throw those in the trash. And NOT tell where they came from.
Her defense lawyer at the CM might have found that entertaining.

Anyhow, her big mistake was joining the Crotch to begin with but once
in you gotta play the game.

BTW, hey EVERYBODY the Pentagon is going to ban religious displays
like beards and turbans, right? There will be no rainbow displays
anywhere outside the 42nd Infantry Division, right?

As I read the story she didn't lose any one of those rights, she was able exercise each one.

No it doesn’t. The military isn’t a democracy. The Uniform Code of Military Justice (UCMJ) is the governing authority. Insubordination is specifically addressed as a crime under military law.

This ex-marine should have done what she was told to do. Without question.
