A judge in Baltimore Monday acquitted the highest-ranking officer charged in the death of Freddie Gray, marking the fourth trial that prosecutors failed to win.
Lt. Brian Rice faced charges of involuntary manslaughter, reckless endangerment and misconduct in office. He opted for a bench trial by Baltimore Circuit Court Judge Barry Williams.
The judge previously dismissed a second-degree assault charge, and prosecutors dropped a second misconduct charge against the 42-year-old officer, who is white.
Gray died a week after suffering a spinal injury in a police van last year, touching off protests and rioting.
Rice's failure to seatbelt Gray, Williams said, may have been an error in judgment and a violation of updated policy -- but the judge found prosecutors failed to prove it rose to a criminal level.
"The state failed to show that the defendant, even if he was aware of the risk, consciously disregarded that risk," the judge said.
Baltimore State's Attorney Marilyn Mosby vowed to bring justice to an aggrieved citizenry when she announced the charges last year. But she has yet to find success in court, and is being sued for defamation by five of the officers.

One of the last things I did before sending my daughter off to college with one of the family cars was to "anonymize" her ride.
I removed every parking pass, every conservation center sticker, every bit of identifying information except the license plate. There is absolutely no reason to share any information about yourself with anybody else on the road.
If she wants to put the name of her college on the back window, we'll talk. Every car in that town has that decal. Her car would stand out if it didn't have it...
Or go to the opposite extreme. They'll never touch it!.....................
Cue the HA Ha! Simpsons pix.
The honorable judge is black
A dangerous person on many counts.
His spine was 80% severed at the neck.
Sorry but that doesn’t happen easily.
And it happened in police custody. What’s wrong with this picture?
Not all sustained injuries are from criminal acts.
Despite being found innocent... the mayor is going to put him before an internal review? Bureaucrats, always sore losers. At least they can’t shoot us here in the street like Stalin’s or Hitler’s troops did....
Awesome.....can’t shoot us in the streets you say? All the govn agencies and quasi agencies are well armed. What’s that for?
This goosestepping political whore should be cuffed and stuffed!!
Oh indeed.... there is reason to be alarmed. Why did the IRS need shotguns, ammo by the bulk and gun training? That doesn’t sound right. There are of course numerous agencies that have been buying up guns and ammo for the last few years...
Then that executive order a week or two ago allowing for the military to use lethal force on civilians.
Yep. Not good.
The yellow rose of Baltimore
There was testimony (that appears to have disappeared) from an individual in the other compartment of the paddy wagon that the occupant seemed to be throwing himself around. The assumption is that he was trying to get bruised up for a police brutality lawsuit, and hit his head too hard at the wrong angle. The other occupant, IIRC, didn't mention a "rough ride" as alleged by the criminal conspirators.
This is a serious case of prosecutorial misconduct.
Did you happen to see her expose in Vogue? Its farcical, even more so today.
4 down, 2 acquittals to go.
Maryland “Freak State” PING!
She looks just like that James Earl Jones character in one of the Conan The Barbarian movies.
Wait a minute. If this was "a violation of updated policy", then either he failed to follow it, or one of his superiors failed to advise him of it. Either way, the BLM mobs just may have a valid point for once.
Judge Barry Williams for the Supreme Court.....
