Ahhh...if it is consensual, which it was according to the witnesses that saw her go willing with him..it is not rape.

That is why he was not charged. She had no recollection and her actions at the party indicated she had intent to bed the poor innocent chap, she came on to him. When she realized what she did sober she had second thoughts...and I gave you the realist explanation for how that plays out in the modern day, having spent some time in my greener days in that world.
As for fornication, well it is a sin, so, technically is jerking off, or going to a pro, or having a girl perform a hand job (not sure about he last) and yet...I doubt that many man have not so sinned in youth prior to marriage. I very much doubt any man who has been in service and has had “deadly sperm buildup” (DSB) has not dealt with the issue. Every base has its recognized whore houses outside the gate that specialize in service personnel.
So it is not ideal, but ..well the root of the word “Sin” is an archery term. It means missing the mark. We humans miss the mark a lot.
Further we have set up a system where men need darned near ten years of education and work to be able to afford to marry...exactly at the time they are most in need of female company. What do suppose the young chaps are going to do?

So my answer is yes, I am a Christian, but I recognize the world we live in is fallen and folks are not perfect. While young men are dogs, young women are by no means pure in thought, deed or actions these days. Far from it and the Christians that still treat/think women are thinking we are told they did 100 years ago is missing reality.
So in conclusion, “opps I did it with a guy I would not in a sober state” regret is not the same thing as rape. He did not commit a crime under the law.
The Judge of the whole earth will render a verdict as to whether he raped her (had sexual relations when she was incapable of consent).
