An indigenous woman in Calgary, Canada who yelled “I hate white people” before punching a white woman in the face and knocking her tooth out did not commit a racially motivate hate crime, a provincial court judge has ruled.
Judge Harry Van Harten’s written decision in the case argued that the motivation of the perpetrator, Tamara Crowchief, in the attack on the victim, Lydia White, was not related to racial bias.
The judge disagreed with the prosecutor’s argument that the unprovoked assault, which occurred in November 2015, rose to the level of a hate crime.
Van Harten said there wasn’t enough evidence to establish the claim that Crowchief attacked White because of her skin color, despite the fact that the perpetrator, who had never met the victims before the attack, yelled “I hate white people” before throwing a punch.
“There is no evidence either way about what the offender meant or whether … she holds or promotes an ideology which would explain why this assault was aimed at this victim,” the judge said. “I am not satisfied beyond a reasonable doubt that this offence was, even in part, motivated by racial bias.”

I must wonder if even Trump can clean things up in a seriously broken legislative, judicial, and administrative system that has been built up since the New Deal. He is, humanly speaking, our main opportunity for reform.
I’m guessing if the victim shot the assailant in self-defense, it would have IMMEDIATELY been labelled a hate crime.
There is neither racism nor hate crimes. When there is no closed form definition, they cannot exist.
It’s never racist hate when a minority attacks, assaults, rapes, burns, punches, slaps, stabs, strangles, shoots, or beats a white person. It’s only racist hate for a white person to notice.
But had it been the other way around, it would have been right?.....................
This isn’t even liberalism, which had a good end in mind. This is scatter shot libertinism.

Literally. The whole tenor of things seems to be to curse what can be cursed, rather than bless what can be blessed... and this isn’t even just a “liberal” thing. I’ve seen it on FR too.
Iwas once mugged by two black guys who told me, We don’t care if we kill you ‘cause you white.” Guess that wasn’t a hate crime, either.
God has been replaced by wherever the will of the rabble seems to want to go.
There was always room for yielding, but it used to be to convictions of honor and good sense, or to put it more specifically, to God (of the loving, gracious kind, not the crabbed kind of Islam and some self-willed Christian followings). That would result in something constructive.
We have got to get back to that kind of God. The bible always presented it, but our own crabbed minds did not want to see anything that would open them up. The result is that minds that knew they needed to be opened, let themselves be opened by any old garbage and we call that “liberalism” today.
Justice in Canada must be deaf and dumb in addition to blind. Or just plain stupid.
If what the original high minded people who set forth the idea of “hate crime” had been continued to be observed, yes that would count as such.
Canada has piled ludicrous on ludicrous... I’m not sure even the US is quite that zany yet, but it is approaching if it isn’t there.
There’s a curious song “If I Were A Redneck” by a certain Canadian punk band. It depicts rednecks getting into all manner of ungodly mischief, but I at least get the sense that the composer was secretly jealous. That they could like their ungodly mischief even better than the composer does his, because there is almost a kind of innocence about it.
I will cheer.
According to the FBI site.....”Hate is not a crime in itself”.
If she weren't Canadian, she'd be the perfect running mate for Hillary. At least she'd be a more authentic Indian than Elizabeth Warren.

I’d rather meet an honestly evil man or woman any day, than one who hides it from you.
The perp shouts "I hate white people" while assaulting a white person, and the judge isn't convinced that this was a racial attack. In contrast, if a white person attacked an Indian or any other non-white, it would be treated automatically as a hate crime even if the perp never even mentioned race.
Well as the wag says, where are all these love crimes?
